40. Final Plat or Cluster Plat Map - The final permanent reproducible drawing of a <br /> prepared subdivision and dedication required for filing for record with the <br /> County Auditor. <br /> 41. Hearing Examiner - The Land Use Hearing Examiner for the City. <br /> 42. Improvement - Any structure or work constructed including, but not limited to, <br /> roads, storm drainage systems, sanitary sewage facilities, water mains, parks, <br /> and pedestrian and landscaping improvements. <br /> 43. Industrial Zones - As established in the Everett Zoning Code. <br /> 44. Lot - A fractional part of divided lands having fixed boundaries and being of <br /> sufficient area and dimension to meet minimum zoning requirements or <br /> standards specified in this Ordinance for street frontage, depth,_ width, and <br /> area. The term shall include tracts, parcels, and sites. <br /> 45. Open Record Public Hearing - A hearing conducted by a single hearing body or <br /> the City's Hearing Examiner that creates the City's record through testimony <br /> and submission of evidence and information. <br /> 46. Panhandle Lot - A lot where access is provided to the bulk of the lot by means <br /> of a narrow strip of land which is used principally for access purposes and is not <br /> intended to meet the full frontage or width requirements of the Everett Zoning <br /> Code. <br /> 47. Person - For the purpose of this Ordinance, the term "person" shall include, but <br /> not be limited to, the following: individuals, corporations, associations and <br /> partnerships. <br /> 48. Phasing Plan - A plan approved by the City for incremental installation of <br /> public and private improvements. <br /> 49. Preliminary Approval - An official action on a proposed division of land that <br /> refers to placement of specific conditions which must be complied with before <br /> final approval may be granted. <br /> 50. Preliminary Plat, Short Plat, Cluster Plat or Cluster Short Plat, and Binding Site <br /> Plan - A neat and approximate drawing of a proposed division of land showing <br /> the general layout of streets, lots, blocks, existing and proposed easements, and <br /> other elements consistent with the requirements of this Ordinance. <br /> 51. Redivision - The division of land in an approved Subdivision, Short <br /> Subdivision, or Binding Site Plan. <br /> 52. Restrictive Covenant - Restrictive Covenant - A restriction or control imposed <br /> on the use of land other than by a condition or easement. A restrictive covenant <br /> runs with the land and may be placed on the face of the final division map or <br /> filed separately at recording of the final division maps. <br /> 53. Request for Final Approval - A request made by the applicant for final approval <br /> of a division of land, when the applicant has completed all the requirements of <br /> preliminary approval. <br />
