Rules and Regulations <br /> A. Variance Requirements <br /> 1. Variance for New Lots Created: <br /> All variances for new lots created under this Ordinance shall be heard by the <br /> Director or Hearing Examiner per the requirements of this Ordinance. <br /> 2. Variance from Lot Requirements Only: <br /> Applications for variances authorized by this Ordinance are limited to variances <br /> as provided for in the Everett Zoning Code and lot requirements of Sections <br /> 7.F.2, 16, 20, and Section 8.B of this Ordinance. Variances are not permitted <br /> from other sections of this Ordinance. <br /> 3. Variance by Director: <br /> For divisions of land, the Director using Review Process II as defined in <br /> Ordinance No. 2136-96, as amended, has the authority to grant a request for a <br /> variance of 25% or less. The application shall be submitted with the proposed <br /> project application. <br /> 4. Variance by Hearing Examiner: <br /> For divisions of land, the Hearing Examiner using Review Process III as <br /> defined in Ordinance No. 2136-96, as amended, has the authority to grant a <br /> variance of more than 25%. The application shall be submitted with the <br /> proposed project application. <br /> 5. Variance Criteria: <br /> In order for the Director or Hearing Examiner to grant a variance, he/she must <br /> find that all of the following conditions have been met: <br /> a) There are exceptional circumstances or conditions such as location of <br /> existing structures, lot configuration, topographic or unique physical <br /> 75 <br />
