w <br /> tract, or parcel under this Ordinance, the offer or agreement is not a violation of <br /> any provisions of this Ordinance. All payments on account of an offer or <br /> agreement conditioned as provided in this section shall be deposited in an <br /> escrow or other regulated trust account and no disbursement to sellers shall be <br /> permitted until the final maps are recorded. <br /> J. Non-Exclusive Provisions <br /> Penalty and enforcement provisions provided in this Ordinance are not exclusive, and <br /> the City may pursue any remedy or relief it deems appropriate or as otherwise provided <br /> by law. <br /> K. Severability <br /> Should any section, subsection, paragraph, sentence, clause or phase of this Ordinance <br /> or its application to any person or situation be declared unconstitutional or invalid for <br /> any reason, such decision shall not affect the validity of the remaining portions of this <br /> Ordinance or its application to any other person or situation. The City Council hereby <br /> declares that it would have adopted this Ordinance and each section, subsection, <br /> sentence, clause, phrase or part thereof irrespective of the fact that any one or more <br /> section, subsection, sentences, clause, phases or portions be declared invalid or <br /> unconstitutional. <br /> L. Supersede <br /> The provisions of this Ordinance shall supersede Ordinance No's. 4157, 368-75, <br /> 517-78, 816-81, 817-81,1119-85, 1327-87, 1831-91, 1984-93, 2046-95, Section 9 of <br /> 3-68 relating to subdivisions and short subdivisions and all other ordinances in conflict <br /> herewith are repealed as of the effective date of this Ordinance. <br /> M. Effective Date <br /> This Ordinance shall take effect and be in force fifteen (15) days after becoming valid. <br /> N. Rules and Regulations <br /> The Director and/or City Engineer is authorized to promulgate rules and regulations <br /> which are consistent with the terms of this Ordinance. <br /> 80 <br />
