{ <br /> a) Permitted Areas: <br /> i) For Category I wetlands, facilities shall be permitted only within <br /> buffer areas where there has been prior legal alteration which <br /> eliminated significant vegetation and where a buffer enhancement <br /> plan is provided for the proposed facility <br /> ii) For Category II wetlands, facilities shall be located to minimize <br /> reduction of the required buffer. To the maximum extent <br /> feasible, facilities shall be located within buffer areas where there <br /> has been prior legal alteration or in buffer areas with less than <br /> 50% forested/native vegetation cover. <br /> iii) Buffer areas for Category III and IV wetlands. <br /> b) Criteria: <br /> i) Permitted facilities shall not substantially alter wetland hydrology <br /> and shall not degrade wetland functions; <br /> ii) Facilities shall not occupy more than 50% of the total required <br /> buffer area; <br /> iii) Facilities shall be designed to be integrated into the wetland <br /> buffer as a natural drainage system meeting the requirements as <br /> established in the City's Land Division Ordinance Section <br /> 7.F.3.i. i) and 7.F.11.c.i). The slopes and all areas that are <br /> disturbed shall be planted with the native vegetation consistent <br /> with a buffer enhancement/mitigation plan. Above ground <br /> concrete walls and structures are not permitted. Below grade <br /> structures may be permitted only if it can be shown to the <br /> satisfaction of the Planning Director, that the use of such <br /> materials fits with the natural design of the proposed facility and <br /> does not interfere with wildlife passages or adversely impact <br /> biological functions of the buffer or the adjacent Environmentally <br /> Sensitive Area; <br /> iv) The location of a maintenance/access road is limited to the upland <br /> side of the facility, unless other wise approved by the Planning <br /> Director; and <br /> 4 <br />
