any necessary act preliminary to or incidental to such work or authorized or directed <br /> pursuant to this code. <br /> Section 28: Procedure- City Council Authorization - Emergency <br /> A. Procedure. Whenever the required repair or demolition is not commenced or <br /> completed as ordered by the violations hearing examiner, then, following notice of <br /> Council hearing being provided to the names and addresses of the persons entitled to <br /> service under Section 11 of this code and the adoption of a resolution by the City <br /> Council, the work shall be accomplished by City personnel or by private contract under <br /> the direction of the building official. Plans and specifications therefor may be prepared <br /> by said building official or the building official may employ such architectural and <br /> engineering assistance on a contract basis as he or she may deem reasonably necessary. <br /> If any part of the work is to be accomplished by private contract, standard City <br /> contractual procedures shall be followed. <br /> B. Emergency Resolution. Notwithstanding any provision of this code, in the event it <br /> reasonably appears that there is immediate danger to the life or safety of any person or <br /> property unless a dangerous building is immediately repaired, secured, vacated or <br /> demolished, the building official may dispense with the issuance of a violation citation <br /> and report the facts directly to the City Council,who may by resolution authorize the <br /> building official to effect the immediate repair, securing, vacation or demolition of the <br /> dangerous building. The City's costs of the emergency repair, securing, vacation, or <br /> demolition of such dangerous buildings shall be collected in the same manner as provided <br /> herein for non-emergency repair or demolition. <br /> C. Contest. The decision of the City Council concerning the authorization of the work <br /> to be accomplished by City personnel or by private contract shall be final and conclusive. <br /> This decision shall not be contested in any action or proceeding unless the same is <br /> commenced within 21 days of the date the City Council passes the resolution. <br /> Section 29: Repair and Demolition Fund <br /> Payments made by the City for repair and demolition shall be made from a special <br /> revolving fund to be designated as the repair and demolition fund and may be made a <br /> special assessment against the property involved, or may be made a personal obligation of <br /> the property owner when authorized by the City Council. Payments shall be made out of <br /> said fund upon demand of the director of public works or code compliance to defray the <br /> costs and expenses which may be incurred by this jurisdiction in doing or causing to be <br /> done the necessary work of repair or demolition of dangerous buildings. <br /> Section 30: Account of Expense, Filing of Report <br /> The building official shall keep an itemized account of the expense incurred by the City <br /> in the repair or demolition of any building authorized by resolution of the city council as <br /> provided in this code. Upon the completion of the work of repair or demolition, said <br /> building official shall prepare and file with the City Clerk a report specifying the work <br /> done,the itemized and total cost of the work, a description of the real property upon <br /> 13 <br />
