declaring the time, date and manner in which service was made. The declaration, <br /> together with any receipt card returned in acknowledgment of receipt by certified mail, <br /> shall be affixed to the copy of the violation citation retained by the building official. <br /> Section 25: Hearing <br /> If the person to whom the violation citation is directed fails to complete the corrective <br /> action required therein by the date set forth therein, a hearing is to be held in accordance <br /> with the provisions of Chapter 1.20 of the Everett Municipal Code and the violations <br /> hearing examiner shall have the same powers and duties as set forth therein. The <br /> violations hearing examiner shall issue written findings of fact, conclusions of law, and <br /> order. A copy of such findings of fact, conclusions of law and order shall posted upon <br /> the subject property, and in addition shall be delivered to the appellant personally or sent <br /> by certified mail, postage prepaid,return receipt requested. The effective date of the <br /> order shall be as stated therein. <br /> Section 26: Effect of Failure to Appear <br /> If the person to whom the violation citation is directed has been served with notice as <br /> provided in this code and subsequently fails to complete the corrective action required <br /> therein by the date set forth therein and fails to appear at the hearing, the violations <br /> hearing examiner has the authority to issue an order of default as provided in Chapter <br /> 1.20 of the Everett Municipal Code. <br /> Section 27: Recordation of Order <br /> If compliance is not had with an order issued by the violations hearing examiner within <br /> the time specified therein, and no appeal has been properly and timely filed, the building <br /> official shall file in the office of the county recorder a certificate describing the property <br /> and certifying (i) that the building is a substandard building and(ii) that the owner has <br /> been so notified. Whenever the corrections ordered shall thereafter have been completed <br /> or the building demolished so that it no longer exists as a substandard building on the <br /> property described in the certificate, the building official shall file a new certificate with <br /> the county recorder certifying that the building has been demolished or all required <br /> corrections have been made so that the building is no longer substandard, whichever is <br /> appropriate. <br /> Section 28: Repair,Vacation and Demolition <br /> The following standards shall be followed by the building official,by the City Council in <br /> the event of an emergency resolution, and by the violations hearing examiner if a hearing <br /> is held, in ordering the repair, vacation, or demolition of any substandard building or <br /> structure: <br /> 1. Any building declared a substandard building shall either be repaired in <br /> accordance with the current Building Code or other current code applicable to the <br /> type of substandard conditions requiring repair, or shall be demolished at the <br /> option of the owner. <br /> 2. If the building is in such condition as to make it immediately dangerous to life, <br /> limb, property or safety of the public or its occupants, it shall be ordered vacated; <br /> a vacated building may be required to be secured against unauthorized entry. <br /> 17 <br />
