• <br /> /j0/1"/IP <br /> ORDINANCE NO. 2335-98 <br /> AN ORDINANCE amending the Civil Code Enforcement Procedures, Ordinance No. <br /> 1383-87 as amended(Chapter 1.20 EMC). <br /> WHEREAS,the City's civil code enforcement procedures have proven to serve as a <br /> valuable tool as part of the City's overall enforcement program; and <br /> WHEREAS,while the civil enforcement procedures have been effective, there are <br /> significant demands being placed on the existing system which demands must be <br /> mitigated by making the existing system more efficient; and <br /> WHEREAS,to better address the civil violations of the City's regulations that endanger <br /> the public health, safety and welfare, it is necessary to make the following amendments to <br /> the civil code enforcement procedures; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 2 of Ordinance No. 1383-87 as amended by Section 1 of Ordinance <br /> No. 1780-91 and Section 1 of Ordinance No. 2221-97 (EMC 1.20.010), which reads as <br /> follows: <br /> EMC 1.20.010 Notice of violation-Issuance-Appeal-Voluntary correction agreement. <br /> A. The City's code compliance officer(s) are authorized to issue and serve a notice of <br /> violation upon reasonable cause to believe that a violation has occurred of the ordinances <br /> set forth in Section 1.20.020 or such other ordinances that identify the herein described <br /> enforcement procedure as the enforcement procedure for said ordinances. For purposes of <br /> this chapter, a "code compliance officer" is a City employee or employees designated by <br /> the Mayor to implement the enforcement provisions provided herein. The notice shall be <br /> issued to the property owner, landlord and/or to any person causing, allowing or <br /> participating in the violation. Additionally, a copy of such notice or a summary thereof <br /> may be sent to the mortgage holder, landlord or anyone else who may have an interest in <br /> the property.
