<br /> the express intention of this clause being to prevent the exhibiting
<br /> of such signs, placards , symbols or other devices as state , advertise
<br /> or purport to advertise assigned, auction, creditor , assigned to cred-
<br /> itor, bankrupt, fire , fire damage, or damaged, water damage or dam-
<br /> aged, underwriter , underwriter samples , drummers ' samples, manufact-
<br /> urers1 samples, jobbers ' samples , railroad wreck, salvage , steam-
<br /> ship or boat , sail ship or boat , going out of business, closing out ,
<br /> retiring from business , bursted, outed, broke , United States Mar-
<br /> shall , Trustee , Sheriff , Constable, liquidation, or other like
<br /> sales , which are not bona fide as advertised, and which are not
<br /> in fact a true offering, or any sale advertised by signs , symbols
<br /> or other device regardless of the wording or matter used on said
<br /> signs, symbols, or other device , which is intended to deceive any
<br /> person or the public in general as to the nature or character of
<br /> of said advertisement of sale . It being further intended that the
<br /> mere changing or faulty spelling of any of the above or similar
<br /> words designating such sales or offers of sale shall notrelieve
<br /> the violator so doing from the purport and effect and provisions
<br /> of this ordinance.
<br /> Section 9 . Any person violating any of the provisions
<br /> of this ordinance shall be deemed. guilty of a misdemeanor , and
<br /> • upon conviction thereof shall be punished by a fine of not more
<br /> than One Hundred Dollars ( 100.00) , or by imprisonment in the
<br /> city jail for a period of not more than thirty days or by both
<br /> such fine and imprisonment.
<br /> Section 10. Every person concerned in any act or omis-
<br /> sion in violation of this ordinance, whether he directly performs
<br /> or omits to perform any act in violation of this ordinance , or dds •
<br /> or abets the same , whether present or absent, and every person
<br /> who directly or indirectly counsels, encourages, hires, commands ,
<br /> induces , or otherwise procures another to commit such violation
<br /> is, and shall be , a principal under the terms of this ordinance ,
<br /> and. shall be proceeded against and prosecuted as such.
<br /> Section 11 . None of the provision of this ordinance
<br /> . shall apply to any person engaged in the business of commercial
<br /> printing, any person engaged in the business of publishing any
<br /> newspat er or periodical , or any agent of such persons , who pub-
<br /> lish any such advertisement in good faith and without knowledge
<br /> of the falsity thereof.
<br /> Section 12. No prosecution now pending, and no offense
<br /> heretofore committed under ordinances heretofore enacted shall
<br /> be affected in any way by the passage of this ordinance , but
<br /> all such prosecutions shall be conducted to final judgments ,
<br /> and. all such offenses shall be prosecuted in the same manner
<br /> as if this ordinance had not been enacted.
<br /> Section 13 . If any section, sub-section, sub-division
<br /> sentence , clause or phrase of this ordinance is for any reason
<br /> held to be unconstitutional or vi-dd., such decision shall not
