E-Mail to Hearing Examiner Office from Mark Robbins, Connell Design Group, dated <br /> 1115/01 re: Response to City's Traffic Mitigation Fee Proposal <br /> All of the exhibits are available for inspection at the Hearing Examiner's Office located at <br /> 2930 Wetmore Avenue, 8°"floor, Everett,Washington. <br /> After due consideration of the testimony and evidence presented by the Applicant. testimony <br /> and evidence elicited during the public hearing, and as the result of the personal inspection of <br /> the subject property and surrounding areas by the Everett Hearing Examiner, the following <br /> Findings of Fact and Conclusions constitute the basis of the decision of the Everett Hearing <br /> Examiner. <br /> FINDINGS OF FACT <br /> 1. The Applicant requested approval of a Special Property Use Permit for the <br /> construction of a single-story wood-framed 3,000 square foot daycare facility (Everett <br /> Country Club Daycare)with six off-street parking stalls to be developed at 1300-100e' <br /> Place SE, Everett,Washington. The subject property, a 1.2 acre parcel of land, is <br /> zoned R-3, Multiple-Fam Medium Density. In order for a daycare facility to be <br /> constructed,a Special Property Use Permit is required. (exhibit 1) <br /> 2. The subject property is developed as multiple-family residential, Everett Country Club <br /> Apartments. The properties to the south and east have simile'developments and are <br /> also zoned R-3. The property to the north is zoned C-1 and is undeveloped. The <br /> property to the west is zoned R-3 and is undeveloped. (exh3t 1) <br /> 3. In order for a Special Property Use Permit to be granted within the City of Everett,the <br /> General criteria of Everett Municipal Code(EMC) 19.41..150.0 must be satisfied. A <br /> summary of tha;criteria iir udes; <br /> a) The need of the neighborhood,district, or City for a proposed Special Properly <br /> Use. <br /> (b) The adequacy of streets, utilities,and public services required to serve a <br /> proposed use. <br /> (c) The impact of traffic generated by the proposed use on the surrounding area, <br /> pedestrian circulation and public safety; and abiNty of the proponent to mitigate such <br /> potential impacts. <br /> (d) The provision of adequate of-street parking,on site circulation,and site <br /> access. <br />
