The Port reserves the right to use the Easement Area so long as such use does not unreasonably <br /> impede the rights granted to the City hereunder. City acknowledges and agrees that the Port <br /> may use the Easement Area for parking, sidewalks, and landscaping. <br /> 2. No Interference with Use of Easement Area. <br /> (a) The Port and its representatives, employees, agents, contractors, licensees <br /> and/or guests shall not interfere with or obstruct the City's use of the Easement Area, or in any <br /> way interfere with, obstruct or endanger the usefulness of any utilities infrastructure or <br /> improvements located thereon. The City and its representatives,employees,agents,contractors, <br /> licensees and/or guests shall not interfere with or obstruct the Port's use of the Easement Area, <br /> or in any way interfere with, obstruct or endanger the usefulness of any improvements located <br /> thereon. <br /> (b) The Port shall be liable for the costs of any repairs to any of the City's utilities <br /> infrastructure or improvements located within the Easement Area necessitated solely by the <br /> actions of the Port and/or its representatives, employees, agents,contractors, licensees, invitees <br /> and/or guests. The City shall be liable for the costs of any repairs to any of the Port's <br /> improvements located within the Easement Area necessitated solely by the actions of the City <br /> and/or its representatives, employees, agents, contractors, licensees, invitees and/or guests. <br /> (c) Prior to any construction, work or any other activity (collectively, the "Port <br /> Work") which the Port proposes to undertake within the Easement Area, the Port shall provide <br /> to the City plans and specifications detailing the Port Work. The City shall review such plans and <br /> specifications and provide comments to the Port with regard to modifications to be made to the <br /> Port Work to avoid interference with the City's utilities infrastructure or improvements; provided, <br /> however,that any such comments made by the City shall be for informational purposes only and <br /> shall not be deemed to be a warranty by the City for any purposes whatsoever. Further,this City <br /> review of the Port's plans and specifications shall not be deemed to impose any duty or obligation <br /> on the City to determine the adequacy or sufficiency of the Port's plans and specifications nor <br /> 2 <br />
