I am a planner with <br />the city reviewing your application for compliance with the Unified Development Code (Title <br />19. At this time, the Planning Department must DENY your permit application due to code <br />that prohibits fences above 6' and prohibits chain link fencing in the MU zone (EMC <br />19.40.010.B). The existing chain -link fence must be removed immediately. Submit a new <br />Public Works permit application with Permit Services to remove all noncompliant fencing. <br />Please see the following for additional site -specific information and required action. <br />1. A history of violation citations regarding an illegal chain -link fence at this site began back in <br />2016 and ended with an Order to Comply issued by the City of Everett Violations Hearing <br />Examiner in 2018 to remove the unpermitted perimeter chain link fence. An inspection by the <br />city's Code Enforcement Department in 2019 confirmed that the fencing material was <br />removed from the fence posts this action brought the property into compliance with the <br />Hearing Examiner's Order and the case was closed. <br />2. Any proposed new or replacement fencing at the subject property must comply with current <br />code regulations in EMC 19.40. <br />3. The subject property is in the MU zone, within Metro Everett, located on "pedestrian" <br />designated streets. Please reference EMC 19.05 for permitted uses in the MU zone on <br />pedestrian streets. <br />4. The subject property has lost its previous nonconforming use status of vehicle <br />maintenance/service due to the property being left vacant for many years. Code states: "Any <br />use which is nonconforming and has ceased for a period of two or more years shall lose such <br />nonconforming status. All subsequent use of the property or building shall be a use which <br />conforms with the requirements of Title 19 (EMC 19.38.020). <br />5. Please confirm with the Planning Department what your use/business operations are on the <br />property. Please reply to this email with this information. <br />6. Per Google Street View, photos show that the building has been altered without permits. <br />Permits must be obtained for this work.
