r 41 ORDINANCE NO. 2323 An Ordinance providing for the improvement of Rockefel- ler Avenue, from the center line of 35th Street to 38th Street, by the removal of old lumber, grading to proper grade, construc- tion of concrete curbs and construction of one course Portland cement concrete pavement 26 feet wide, installation of necessary drainage, also grading for and construction of concrete walks where same are not now in place, and doing all other work neces- sary to make a complete improvement, creating an assessment dis- trict, creating an assessment district, creating a local improve- ment district fund therefor, and providing that payment for said improvement be made by special assessment on the property in said district under the mode of payment by bonds, and declaring an emergency. WHEREAS, a majority petition of the property or,ners, pe- titioning for said improvement, has heretofore been filed with the Commissioner of Public Works and said Commissioner has found the things set forth in said petition to be true; and WHEREAS, said Commissioner of Public Jorks has filed with the City Council all data and information, as required by law; and WHERE AS, said Commissioner of Public Jorks has recommend- ed to the City Council that said improvement petitioned for be made, and it appearing to the City Council that public conven- ience and necessity requires such improvement to be made; now, therefore, THE CITY OF EVERETT DOES ORDAIN: Section 1: That Rockefeller Avenue, from the center. line of 35th Street to 38th Street, be improved by the removal of old lumber, grading to proper , grade, construction of concrete curbs and construction of one course Portland cement concrete pavement 26 feet vide, installation of necessary drainage, also grading
