To the Honorable Mayor and the City Council <br /> of the City of Everett,- <br /> / ,. <br /> The undersigned owners of Lots - ' ,-A-- n block <br /> Plat of Everett, Snohomish County, Washington, hereby <br /> protest against the granting of a franchise to the Independent <br /> Truck Company, or any other concern, for the placing of a <br /> spur or track in the alley in Block Plat of Everett, <br /> for the following reasons: h <br /> kip <br /> 1. That it will prevent the free use of said alley by <br /> these protesters and the public. <br /> 2. That it will render the residences of these protesters <br /> worthless, as they will have no means of getting in fuel or <br /> provisions in their home . <br /> 3. That these protesters are the owners of the business <br /> property facing on the Avenue and said alley, and it will <br /> compell all loading and unloading to be done on Everett Avenue <br /> instead of being done as now done in the alley, and Everett <br /> Avenue being a congested thoroughfare , the loading and un- <br /> loading which must necessarily be done for these concerns <br /> will all have to be done on Everett Avenue if this franchise <br /> is granted, to the detriment of the public and the persons <br /> loading and unloading. <br /> 4. It will be a great detriment to the property of these <br /> protesters because it will deprive them of the use of said <br /> \IL <br /> alley, one-half of the fee therein being owned by these pro- <br /> testers. <br /> 5. No time is stated in the application for franchise <br /> as to when and how the cars on said track or the time they <br /> 11 are to be left on the same , nothing said about the paving or <br /> tearing up which necessarily must be done if the track is put <br /> in. <br /> 6. That if petitioners wish a track, it is their duty to <br /> buy a privy ,e right-of-way, and do business at their own ex- <br /> pense of the public, especially at the expense of these pro- <br /> 47 te s to?s. <br /> We wish to call your attention to sections 108 and <br /> 113 of our City Charter, which provides in substance that no <br /> franchise shall be granted without compensation to the city, <br /> and section 113 provides in substance that conditions should <br /> be stated upon which the franchise is granted. <br />
