• 40 ORDINANCE NO. 2F,b0 An Ordinance providing for the improvement of Cleveland Avenue from 22nd Street to 24th Street by clearing, grubbing, grading to proper grade, construction of concrete curbs, walks and gutters, installation of necessary drainage and doing all ot- her work necessary to make a complete improvement, creating an assessment district, creating a Local Improvement District Fund therefor and providing that payment for said improvement be made by special assessment on the property in said District under the mode of payment by bonds. Whereas, a majority petition of the property owners, pe- titioning for said improvement, has heretofore been filed with the Commissioner of public :forks and said Commissioner has found the things set forth in said petition to be true; and Whereas, said Commissioner of Public Works has filed with the City Council all data and information, as required by law; and Whereas, said Commissioner of public Yorks has recommend- ed to the City Council that said improvement petitioned for be made, and it appearing to the City Council that public convenience and necessity requires such improvement to be made; now, therefore, THE CITY OF EVERETT DOES ORDAIN: Section 1: That Cleveland Avenue from 22nd Street to 24th Street, be improved by clearing, grubbing, gr:-ding to proper grade, construction of concrete curbs, walks and gutters, installation of necessary drainage and doing all other work necessary to make a complete improvement, according to the plans and specifica- tions, prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of such improvement, including all necessary incidental expenses, shall be borne by and -1-
