t 4-o <br /> Planning and Community Development Department <br /> &a2Zoning Code Compliance Notice <br /> June 13,2014 <br /> James Heighton <br /> 1242 Youngwood Road <br /> Camano Island, WA 98282-7614 <br /> Re; 10024 19`x'PI West <br /> Dear Mr.Heighton: <br /> The purpose of this letter is to follow up on your June 5, 2014 meeting with Steve Ingalsbe regarding recent <br /> dredging of Swamp Creek and grading at the above address. The following steps must be taken to bring your <br /> property into compliance with Chapter 37 of the zoning code: <br /> 1. Submit a State Environmental Policy Act (SEPA) application by June 23, 2014. <br /> 2. Provide a restoration planting plan for the disturbed wetland and stream buffer by a qualified biologist <br /> that is acceptable to the City of Everett Planning Department by August 13,2014. <br /> 3. Restore the stream and wetland and their buffers as required by the approved restoration plan. The <br /> restoration work must be completed no later than October 15,2014 or as otherwise required by the Hydraulic <br /> Project Approval(HPA)from the Washington State Department of Fish and Wildlife(WSDFW). <br /> 4. Obtain a HPA from WSDFW. Provide documentation to the City that a HPA has been applied for once <br /> SEPA is completed. <br /> 5. Record a Critical Area Protective Covenant with the Snohomish County Auditor's Office by October 15, <br /> 2014.The Planning Department must review the completed covenant prior to it being recorded. <br /> 6. Install a Critical Area sign and fence along the agreed upon boundary of the wetland and stream buffer <br /> that is acceptable to the City of Everett Planning Department by October 15,2014. <br /> 7. Provide a maintenance assurance device by October 15, 2014. The assurance must not be less than 10% <br /> of the cost of plant material, labor, monitoring and maintenance. The assurance shall be released at the end of <br /> the three year monitoring period if the restoration of the area meets the performance standards as outlined in <br /> the plan. It is the owner's responsibility to contact the Planning Department at the end of the three year <br /> period. <br /> As an alternative to the above requirements, you may pursue other options that are available in Chapter 37 of <br /> the City of Everett Zoning Code or other deadlines.
