and inserting in its place: <br /> Section 103.1.4 For the purpose of determining suitable alternate materials, alternate <br /> types and methods of construction and reasonable interpretations regarding the UFC, any <br /> person aggrieved by an order or action of the Fire Marshal who does not have an <br /> enforcement procedure pending pursuant to Chapter 1.20 EMC, may file a written request <br /> with the City Clerk requesting a determination by the Board of Review. The aggrieved <br /> party must file such request within thirty calendar days from the date of receipt of the <br /> written order and shall cause to be made at his own expense, any tests or research <br /> required to substantiate the request. <br /> Section 5: Section 7801.3.1.2 of the 1997 Edition of the UFC is hereby amended by the <br /> addition of the following section: <br /> Except as hereinafter provided or as is otherwise provided by State law and/or City <br /> Ordinance, it shall be unlawful for any person to possess, store, offer for sale, expose for <br /> sale, sell at retail or use or explode any fireworks; provided the Chief shall have the <br /> power to adopt reasonable rules and regulations for the granting of permits for supervised <br /> public displays of fireworks by a jurisdiction, fair association, amusement park, other <br /> organization or for the use of fireworks by artisans in pursuit of their trade. Every such <br /> use or display shall be handled by a competent operator, licensed by the state, and/or <br /> approved by the Chief and shall be of such character and so located, discharged or fired <br /> so as, in the opinion of the Chief after proper investigation, not to be hazardous to <br /> property or endanger any person. <br /> Section 6: Appendix I-A, 1. General, of the 1997 Edition of the UFC is hereby amended by <br /> deleting: <br /> 1.2 Effective Date. Within 18 months after the effective date of Appendix I-A,plans for <br /> compliance shall be submitted and approved, and within 18 months thereafter the work <br /> shall be completed or the building shall be vacated until made to conform. <br /> and inserting in its place: <br /> 1.2 Effective Date. Within eighteen(18) months after notification by the Fire Chief to <br /> the owner or the occupant or tenant of the adoption of Appendix I-A, plans for <br /> compliance shall be submitted to and approved by the Fire Chief, and within three (3) <br /> years thereafter, or as approved by the Fire Chief,the work shall be completed or the <br /> building shall be vacated until made to conform. <br /> Section 7: Standard 10-2 of the 1997 UFCS is hereby amended by deleting: <br /> Part II in its entirety(NFPA 72, 1993 Edition). <br /> and inserting in its place: <br /> The National Fire Protection Association's National Fire Alarm Code (NFPA 72, latest <br /> Edition) in its entirety for the body of Part II. Amendments published in Part I of UFCS <br /> 10-2 remain in effect where the body of the standard in the areas amended has not, in the <br /> opinion of the Fire Chief, been substantially altered as to render the amendment invalid <br /> notwithstanding changes in numerical designations. <br /> 2 <br />
