Section 11: The 1997 Edition of the UFC is amended by the addition of the following section: <br /> It is expressly the purpose of this Code to provide for and promote the health, safety and <br /> welfare of the general public, and not to create or otherwise establish or designate any <br /> particular class or group of persons who will or should be especially protected or <br /> benefited by the terms of this Code. <br /> It is the specific intent of this Code to place the obligation of complying with its <br /> requirements upon the permit applicant and any person owning, operating or controlling <br /> any building or structure within the scope of this Code that no provision nor term used in <br /> this Code is intended to impose any duty whatsoever upon the City or any of its officers <br /> or employees for whom the implementation or enforcement of this Code shall be <br /> discretionary and not mandatory. <br /> Nothing contained in this Code is intended to be nor shall be construed to create or form <br /> the basis for any liability on the part of the City or its officer, employees or agents, for <br /> any injury or damage resulting from the failure of a building to comply with the <br /> provisions of this Code, or be reason or inconsequence of any inspector, notice, order, <br /> certificate,permission or approval authorized or issued or done in connection with the <br /> implementation or enforcement of this Code, or by reason of any action of the City <br /> related in any manner to the enforcement of this Code by its officers, employees or <br /> agents. <br /> Notwithstanding any language used in this Ordinance and/or the Codes enacted herein, it <br /> is not the intent of this Ordinance to create a duty and/or cause of action running to any <br /> individual or identifiable person but rather any duty is intended to run only to the general <br /> public. <br /> Section 12: The 1997 Edition of the UFC is amended by the addition of the following section: <br /> Violation Citation -Order <br /> Notwithstanding any language in this Code, in the event a time period is established in: <br /> (1) a violation citation issued by the Code Compliance Officer,the Fire Marshal or his <br /> designee, or(2) an order issued by the Violations Hearing Examiner, said time period <br /> shall supersede the time period provided by this Code. <br /> Section 13: The City of Everett hereby declares that should any section,paragraph, sentence <br /> or word of this Ordinance or of the UFC or UFCS hereby adopted be declared for any reason to <br /> be invalid, it is the intent of the City of Everett that it would have passed all portions of this <br /> Ordinance independent of the elimination herefrom of any such portion as may be declared <br /> invalid. <br /> Section 14: SAVINGS. <br /> The enactments of this Ordinance shall not affect any case, proceeding, appeal or other matter <br /> currently pending in any court or in any way modify any right or liability, civil or criminal, <br /> which may be in existence on the effective date of this Ordinance. <br /> 6 <br />
