2024 Pavement Maintenance Overlay SPECIAL PROVISIONS PW# 3823 34 1 (1). To pay liquidated damages in the amount of $1,000 per working day for 2 failure to splice, test, and make operational induction loops within 10 working 3 days after installation of the final mat of asphalt overlay over each induction 4 loop in accordance with Section 8-20.3(14)C in these Special Provisions. 5 6 (2). In addition to the liquidated damages in (1) above, to pay (according to the 7 following formula) liquidated damages for each working day beyond the 8 number of working days established for Physical Completion, and 9 10 (3). To authorize the Engineer to deduct these liquidated damages from any 11 money due or coming due to the Contractor. 12 13 Liquidated Damages Formula 14 15 LD=0.15C/T 16 17 Where: 18 19 LD = liquidated damages per working day (rounded to the nearest dollar) 20 C = original Contract amount 21 T = original time for Physical Completion 22 23 When the Contract Work has progressed to Substantial Completion as defined in the 24 Contract, the Engineer may determine the Contract Work is Substantially Complete. The 25 Engineer will notify the Contractor in writing of the Substantial Completion Date. For 26 overruns in Contract time occurring after the date so established, the formula for 27 liquidated damages shown above will not apply. For overruns in Contract time occurring 28 after the Substantial Completion Date, liquidated damages shall be assessed on the 29 basis of direct engineering and related costs assignable to the project until the actual 30 Physical Completion Date of all the Contract Work. The Contractor shall complete the 31 remaining Work as promptly as possible. Upon request by the Project Engineer, the 32 Contractor shall furnish a written schedule for completing the physical Work on the 33 Contract. 34 35 1-09.GR1 36 Measurement and Payment 37 38 1-09.6.RTF 39 1-09.6 Force Account 40 (December 30, 2022 APWA GSP) 41 42 Supplement this section with the following: 43 44 The Contracting Agency has estimated and included in the Proposal, dollar amounts for 45 all items to be paid per force account, only to provide a common proposal for Bidders. All 46 such dollar amounts are to become a part of Contractor's total bid. However, the 47 Contracting Agency does not warrant expressly or by implication, that the actual amount 48 of work will correspond with those estimates. Payment will be made on the basis of the 49 amount of work actually authorized by the Engineer. 50
