The City Council, <br /> Everett, Washington: <br /> I hereby protest passage and enactment of <br /> Ordinance No . 2232 , which presumes to transfer the collection <br /> of public moneys due City of Everett, Water Department, from <br /> control of Department of Finance, on following grounds; <br /> 1. Everett's City Charter, Article 1V, Sec. 22b provides <br /> "The Department of Finance shall include the office of clerk <br /> and treasurer. Article X1V, Section 132, reads ; "b. The <br /> Treasurer shall receive and receipt for . all funds .payable to <br /> the city. He shall make his receipt therefor in triplicate. " <br /> Section 133; "The Treasurer shall at the close of <br /> each month report to the Council the amount of moneys received <br /> and disbursed by him, and the amount on hand. " <br /> 2 . The' State Examiner, Bureau of lunicipal Corporations, <br /> 1924 Report, in passing on this question, said ; "Under the <br /> Charter, (Everett) provision, all accounting of the Water <br /> Department must be done in the clerk's office, and the treasurer <br /> the collector of all moneys. " <br /> 3. This proposed ordinance makes the receiver of public <br /> moneys due City of Everett, Water Department, responsible to <br /> the Commissioner of Public Works . <br /> 4. Public moneys payable to the Water Department amount <br /> to approximately 4250,000.00 annually, considerable more than <br /> the amount collected by the general tax levy for current <br /> expense. This ordinance would put the collection of this <br /> large sum under the Commissioner of Public Works, in place of <br /> the bonded officer provided by the Charter of the City. <br /> 5. The proposed action of majority of the City Council <br /> in passing such an ordinance is absolutely contrary to the <br /> City Charter and is void. I hereby record my protest against <br /> such an illegal practice . <br /> Commissioner of Finance . <br />
