ORDINANCE NO. 2362-99 /SIP <br /> ,, <br /> 44/giw <br /> AN ORDINANCE providing for the adoption of the 1997 Edition of the <br /> Uniform Building Code and the Uniform Building Code Standards, and <br /> repealing Ordinance No. 2068-95 (Chapter 16.01 EMC) and Ordinance <br /> No.'s 1732-90, 1731-90, 1613-89 and 1610-89. <br /> WHEREAS, the City Council finds that this ordinance serves to protect the public <br /> health, safety and welfare; and <br /> WHEREAS, the City Council finds that the absence of the regulations adopted by <br /> this ordinance would create a public harm and a public nuisance; and <br /> WHEREAS, the City Council finds that the City is mandated by the State to <br /> implement and enforce the herein adopted code; <br /> NOW,THEREFORE,THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: This Ordinance shall be known as the "Everett Building Code." <br /> Section 2: There is hereby established in the City of Everett, the Building Division <br /> which shall be under the jurisdiction of the Building Official, designated by the Mayor. <br /> Section 3: The Uniform Building Code (hereinafter referred to as "UBC"), including <br /> Appendix Chapters 15, 12 (Div 11), 31 and 33 and the Uniform Building Code Standards <br /> (hereinafter referred to as "UBCS"), published by the International Conference of <br /> Building Officials, as amended by WAC 51-40, being particularly the 1997 Editions <br /> thereof and the whole thereof, save and except such portions as are hereinafter deleted, <br /> modified or amended are hereby adopted by reference and incorporated herein as fully as <br /> if set out at length herein, collectively refereed to herein as the "code" unless specifically <br /> provided otherwise. <br /> Section 4: Amendments made in the Uniform Building Code and the Uniform <br /> Building Code Standards follow: <br /> A. Section 101.2 of the 1997 Edition of the UBC is hereby amended by the addition <br /> of the following language: <br /> It is the specific intent of this Code to place the obligation of complying with its <br /> requirements upon the permit applicant and any person owning, operating or <br /> controlling any building or structure within its scope and no provision nor term <br /> used in this Code is intended to impose any duty whatsoever upon the City or any <br /> of its officers or employees for whom the implementation or enforcement of this <br /> Code shall be discretionary and not mandatory. <br /> 1 <br />
