2 <br /> <br />1.2 Administration <br /> <br /> Except as otherwise provided herein, the Director shall administer, implement, and <br />enforce the provisions of this ordinance. Any powers granted to or duties imposed upon <br />the Director may be delegated by the Director to other City of Everett personnel. The <br />Director may create administrative guidelines to implement the provisions of this <br />ordinance. <br />1.3 Definitions <br /> <br /> Unless a provision explicitly states otherwise, the following terms and phrases, as used <br />in this ordinance, shall have the meanings hereinafter designated. <br />A. Accessible. Accessible, when applied to required pretreatment monitoring or <br />treatment equipment, shall mean direct access without the necessity of <br />removing any panel, door, vehicle, equipment, materials, or other similar <br />obstruction. <br />B. Act or "the Act". The Federal Water Pollution Control Act, also known as the <br />Clean Water Act, as amended, 33 USC 1251 et seq. <br />C. Administrative Penalty (Administrative Fine). A punitive monetary charge <br />unrelated to treatment cost, which is assessed by the Director rather than a <br />court. <br />D. Applicable Pretreatment Standards. For any specified pollutant, Everett <br />prohibitive standards, Everett specific pretreatment standards (local limits), <br />State of Washington pretreatment standards, or EPA's Categorical Pretreatment <br />Standards (when effective); whichever standard is appropriate and most <br />stringent. <br />E. Approval Authority. The state of Washington Department of Ecology. <br />F. Authorized Representative of the User. <br />(1) If the user is a corporation: <br />(a) The president, secretary, treasurer, or a vice-president of the <br />corporation in charge of a principal business function, or any <br />other person who performs similar policy or decision-making <br />functions for the corporation; or <br />(b) The manager of one or more manufacturing, production, or <br />operating facilities, provided, the manager is authorized to make <br />management decisions which govern the operation of the
