ORDINANCE NO. 2365-99 <br /> tits <br /> AN ORDINANCE providing for the adoption of the 1997 Edition of the <br /> Uniform Mechanical Code and repealing Ordinance No. 2072-95 (Chapter 16.02 EMC). <br /> WHEREAS, the City Council finds that this ordinance serves to protect the public health, <br /> safety and welfare; and <br /> WHEREAS, the City Council finds that the absence of the regulations adopted by this <br /> ordinance would create a public harm and a public nuisance; and <br /> WHEREAS, the City Council finds that the City is mandated by the State to implement <br /> and enforce the herein adopted code; <br /> NOW,THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section l: This ordinance shall be known as the "Everett Mechanical Code." <br /> Section 2: The Uniform Mechanical Code, together with Appendices A and C as published <br /> by the International Conference of Building Officials, as amended by WAC 51-42, being <br /> particularly the 1997 Edition thereof and the whole thereof, save and except such portions as are <br /> hereinafter deleted, modified or amended are hereby adopted by reference and incorporated <br /> herein as fully as if set out at length herein. <br /> Section 3: Amendments made in the Uniform Mechanical Code. <br /> A. Section 102 of the 1997 Edition of the Uniform Mechanical Code is hereby amended by <br /> the addition of the following language. <br /> It is the specific intent of these regulations to place the obligation of complying with <br /> these regulations upon the permit applicant and any person owning, operating or <br /> controlling any building or structure within its scope. No provision nor term used in this <br /> Code is intended to impose any duty whatsoever upon the City or any of its officers or <br /> employees for whom the implementation or enforcement of this Code shall be <br /> discretionary and not mandatory. <br /> Nothing in this Code is intended to be nor shall be construed to create or form the basis <br /> for any liability on the part of the City or its officers, employees or agents, for any injury <br /> or damage resulting from the failure of a building to comply with the provisions of this <br /> Code, or by reason or in consequence of any inspection, notice, order, certificate, <br /> permission or approval authorized or issued or done in connection with the <br /> implementation or enforcement of this Code, or by reason of any action of the City <br /> related in any manner to the enforcement of this Code by its officers, employees or <br /> agents. <br /> 1 <br />
