, de • 0 , <br /> ection 2 That the grantee herein , before making any <br /> excavation in any of the streets, avenues, alleys or public *efts <br /> of said city, shall file with the ccussissicimer of public works of <br /> said city a plan showing the streeta, avenues, alleys or other <br /> public/ places xl or parts thereof, and the particular part thereof, <br /> that he desires to occupy and said grantee shall not have authority <br /> to proceed with any of such work until the commissioner of public <br /> works and the city council shall by ve approved said plan, either as <br /> presented , or as by him or the city Council modified or amended, <br /> and shall\ have i-rz nted a permit therefor. <br /> In prosecuting the work of laying down sub <br /> pike, the grantee herein, shall not rake excavations in any streets, <br /> avenues , alleys or public places f .r a distance exceeeding __two _ <br /> blocks at a tine, and upon completing such work, shall leave such <br /> streets, avenues, alleys and other public places in as good repair <br /> as the sr were in before making the excavations; and if such <br /> grantee shall f4jkl so to do , the city of Eve ett shall hi-N c tie right <br /> to put such streets, avenues, alleys and public places in as good <br /> repair as they were before the making of the excavations, and the <br /> cost and expense thereof shall be charged to said grantee arid promptly <br /> repaid by said grantee upon the presentation of an itemized and ver- <br /> ified statement of costs thereof and shall be a lien upon all the <br /> property of 3r id grantee . <br /> All excav• tions so made shall Le carefully <br /> guarded 3 0 as to prevent accident and the re shall be kept along such <br /> work, signs during the day and lanterns during the night, cle; rly <br /> indicating by whom said work is being done.
