The dense vegetation community will provide noise and visual screening between the <br /> proposed residence and the existing wetland area. The removal of invasive vegetation will provide <br /> and increase in habitat quality for local wildlife that utilize the site for refuge,foraging, and nesting. <br /> DECISION: The City of Everett Planning Director grants APPROVAL for the proposed reasonable <br /> use application,subject to the following conditions below. <br /> CONDITIONS: <br /> 1. No buildings or additions may be placed within the 7 foot open space area between the proposed <br /> dwelling unit and the buffer. The dwelling must meet all other zoning code development standards <br /> except for the reduction of the front setback to 0 feet. <br /> 2. The proposed development footprint of the single family dwelling as shown on the critical area map <br /> and site plan cannot be changed without the Planning Director's approval. <br /> 3. Comply with all the recommendations of the Critical Area Report by Wetland Resources, Inc. dated <br /> November 1, 2016. This includes the planting plan, monitoring, and maintenance consistent with <br /> the approved mitigation planning plan and report. Monitoring and maintenance will be the <br /> responsibility of the developer under the direction of the ecologist. Inspection of the plantings is <br /> required when completed. The plantings and other mitigation measures and the construction of a permanent split-rail fence as <br /> shown on the approved site plan must be installed or an assurance device wo a e cos of <br /> planting and fencing must be provided to the City prior to issuance of building permits. <br /> 5. City of Everett Critical Area signs must be placed on the fence as shown on the site plan. Signs may <br /> be purchased from the Permit Services Counter. <br /> 6. Record a Critical Area Protective Covenant prior to issuance of building permits. A Critical Area <br /> site plan must be formatted to meet Snohomish County Auditor standards for recording. Request <br /> the covenant document at the time of building permit submittal. Verify the document is complete <br /> with the Planning Department prior to recording. <br /> 7. A Maintenance Assurance Device shall be submitted after an inspection of the plantings is <br /> completed. The assurance shall be no less than 10% of the cost of the planting material and <br /> installation. Forms are available upon request and they include posting a bond, setting aside funds <br /> in a bank account,or depositing cash with the City of Everett Treasurer in the City Clerk's office. <br /> 8. During construction, the site must be monitored by the Applicant's ecologist. Any problems, <br /> including any conflicts or violations of the sensitive area limitations contained in this decision must <br /> be reported immediately to the Planning and Public Works Department at 425-257-8810. <br /> This is an administrative decision that is appealable to the City's Land Use Hearing Examiner. Any <br /> appeal must be filed with the City within 14 days of the date of this notice.
