ORDINANCE NO. 2366-99 <br /> AN ORDINANCE establishing rates, charges, and requirements for provision of retail sewer <br /> service to areas outside the City of Everett that receive water service from Everett, amending <br /> Ordinance Nos. 627-79,237-73 and 2189-96 (EMC 14.04.020, 040 and 150), and repealing <br /> Resolution No. 4590. <br /> WHEREAS, the City of Everett has for many years provided retail water service to areas outside the <br /> City at surcharged rates; and <br /> WHEREAS, some areas adjacent to the Everett City limits, receiving water service from Everett, can <br /> be provided sewer service by extension of the Everett sewer system; and <br /> WHEREAS, provision of retail sewer service outside the City limits should be subject to a recorded <br /> utility service agreement; and <br /> WHEREAS,provision of sewer service is beneficial to public health and welfare; <br /> NOW,THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 5 of Ordinance No. 237-73 (EMC 14.04.150)which reads as follows: <br /> Section 5. Sewage disposal for areas outside the City of Everett <br /> It is hereby declared to be the policy of the City that sewage disposal service may be provided <br /> through the Everett system for such areas outside and adjacent to the City as can, in the judgment <br /> of the mayor, be feasibly served. Sewage disposal service shall be provided under contract, the <br /> terms of which will include, but are not limited to, the rates, regulations, and conditions as <br /> hereinafter provided. <br /> A. Sewage disposal contract limitation outside City. Contracts for sewage disposal service to <br /> the City's system shall be limited to the county or any municipality or public body under <br /> whose jurisdiction local sewerage facilities may be constructed and operated. <br /> B. Sewage outside City --Review by mayor. Prior to entering any contract, the mayor shall <br /> review the quality and quantity of the sewage to be accepted and shall assure that the City <br /> has the excess capacity to enable it to dispose of the sewage contracted to be accepted. <br /> C. Service charge for sewage outside City. Monthly service charge for disposal to the City <br /> system shall be as provided for in Section 1 plus a surcharge of fifty percent. <br /> D. Construction charge for sewage outside the City. Monthly construction charge for areas <br /> outside the City limits shall be as provided for in Section 2. <br /> E. Connection charge for sewage outside the City. The connection charges for areas outside <br /> the City limits shall be as provided for in Section 3. <br /> F. Trunk and lateral connections outside City. All trunks, laterals or any special facilities <br /> required for acceptance and transportation of sewage which shall be connected to the City <br /> SEWER ORD(LS1/15/99) <br /> 1 <br />
