To determine 3 whether a DBE is performing a commercially useful function, you must evaluate 4 the amount of work subcontracted, industry practices, whether the amount the 5 firm is to be paid under the contract is commensurate with the work it is actually 6 performing and the DBE credit claimed for its performance of the work, and other 7 relevant factors.” 8 9 Disadvantaged Business Enterprise (DBE) – A business firm certified by the 10 Washington State Office of Minority and Women’s Business Enterprises, as 11 meeting the criteria outlined in 49 CFR 26 regarding DBE certification. 12 13 Force Account Work – Work measured and paid in accordance with Section 1-14 09.6. 15 16 Good Faith Efforts – Efforts to achieve the DBE COA Goal or other 17 requirements of this part which, by their scope, intensity, and appropriateness to 18 the objective, can reasonably be expected to fulfill the program requirement. 19 20 Manufacturer (DBE) – A DBE firm that operates or maintains a factory or 21 establishment that produces on the premises the materials, supplies, articles, or 22 equipment required under the Contract. A DBE Manufacturer shall produce 23 finished goods or products from raw or unfinished material or purchase and 24 substantially alters goods and materials to make them suitable for construction 25 use before reselling them. 26 27 Reasonable Fee (DBE) – For purposes of Brokers or service providers a 28 reasonable fee shall not exceed 5% of the total cost of the goods or services 29 brokered. 30 31 Regular Dealer (DBE) – A DBE firm that owns, operates, or maintains a store, 32 warehouse, or other establishment in which the materials or supplies required 33 for the performance of a Contract are bought, kept in stock, and regularly sold 34 to the public in the usual course of business. To be a Regular Dealer, the DBE 35 firm must be an established regular business that engages in as its principal 36 business and in its own name the purchase and sale of the products in question. 37 A Regular Dealer in such items as steel, cement, gravel, stone, and petroleum 38 products need not own, operate or maintain a place of business if it both owns 39 and operates distribution equipment for the products. Any supplementing of 40 regular dealers’ own distribution equipment shall be by long-term formal lease 41 agreements and not on an ad-hoc basis. Brokers, packagers, manufacturers’ 42 representatives, or other persons who arrange or expedite transactions shall not 43 be regarded as Regular Dealers within the meaning of this definition. 44 45 DBE Commitment – The scope of work and dollar amount the Bidder indicates 46 they will be subcontracting to be applied towards the DBE Condition of Award 47 Goal as shown on the DBE Utilization Certification Form for each DBE 48 Subcontractor. This DBE Commitment amount will be incorporated into the 49 Contract and shall be considered a Contract requirement.
