After approval of the training program, information concerning each 1 individual trainee and good faith effort documentation shall be submitted 2 (on DOT Form 272-050). 3 4 6. Flagging programs will not be approved. Other programs that include 5 flagging training will only be approved if the flagging portion is limited to an 6 orientation of not more than 20 hours. 7 8 7. It is the intention of these provisions that training is to be provided in the 9 construction crafts rather than clerk-typists or secretarial-type positions. 10 Training is permissible in lower-level management positions such as office 11 engineers, estimators, timekeepers, etc., where the training is oriented 12 toward construction applications. Some off-site training is permissible as 13 long as the training is an integral part of an approved training program. 14 15 8. It is normally expected that a trainee will begin training on the project as 16 soon as feasible after start of work, utilizing the skill involved and remain on 17 the project as long as training opportunities exist in the work classification 18 or the trainee reaches journey-level status. It is not required that all trainees 19 be on board for the entire length of the contract. The number trained shall 20 be determined on the basis of the total number enrolled on the contract for 21 a significant period. 22 23 9. Wage Progressions: Trainees will be paid at least the applicable ratios or 24 wage progressions shown in the apprenticeship standards published by the 25 Washington State Department of Labor and Industries. In the event that no 26 training program has been established by the Department of Labor and 27 Industries, the trainee shall be paid in accordance with the provisions of 28 RCW 39.12.021, which reads as follows: 29 30 Apprentice workers employed upon public works projects for whom an 31 apprenticeship agreement has been registered and approved with the 32 State Apprenticeship Council pursuant to RCW 49.04, must be paid at 33 least the prevailing hourly rate for an apprentice of that trade. Any 34 worker for whom an apprenticeship agreement has not been registered 35 and approved by the State Apprenticeship Council shall be considered 36 to be a fully qualified journey-level worker, and, therefore, shall be paid 37 at the prevailing hourly rate for journey-level worker. 38 39 Compliance 40 In the event that the Contractor is unable to accomplish the required training hours 41 but can demonstrate a good faith effort to meet the requirements as specified, then 42 the Contracting Agency will adjust the training goals accordingly. 43 44 Noncompliance and Sanctions 45 When a contractor violates EEO provisions of the contract, the Contracting Agency 46 may impose damages in accordance with WSDOT’s Equal Opportunity Compliance 47 Program and the FHWA 1273. These damages consist of additional administrative 48 costs including, but not limited to, the inspection, supervision, engineering, 49 compliance, and legal staff time and expenses necessary for investigating, reporting, 50 and correcting violations, as well as loss of federal funding, if any.
