Edgewater Creek Bridge Replacement November 2023 62 Measurement 1 The Contractor may request that the total number of “training” hours for the contract 2 be increased subject to approval by the Contracting Agency. This reimbursement will 3 be made even though the Contractor receives additional training program funds from 4 other sources, provided such other sources do not prohibit other reimbursement. 5 Reimbursement to the Contractor for off-site training as indicated previously may only 6 be made when the Contractor does one or more of the following and the trainees are 7 concurrently employed on a Federal-aid project: 8 9 1. contributes to the cost of the training, 10 11 2. provides the instruction to the trainee, 12 13 3. pays the trainee’s wages during the off- site training period. 14 15 Reimbursement will be made upon receipt of a certified invoice that shows the related 16 payroll number, the name of trainee, total hours trained under the program, 17 previously paid hours under the contract, hours due this estimate, and dollar amount 18 due this estimate. The certified invoice shall show a statement indicating the 19 Contractor’s effort to enroll minorities and women when a new enrollment occurs. If 20 a trainee is participating in a SATC/ATELS approved apprenticeship program, a copy 21 of the certificate showing apprenticeship registration must accompany the first 22 invoice on which the individual appears. Reimbursement for training occurring prior 23 to approval of the training program will be allowed if the Contractor verbally notifies 24 the Engineer of this occurrence at the time the apprentice/trainee commences work. 25 A trainee/apprentice, regardless of craft, must have worked on the contract for at 26 least 20 hours to be eligible for reimbursement. 27 28 Training hours that are not in compliance with the approved training plan will not be 29 measured. 30 31 Payment 32 The Contractor will be reimbursed under the item “Training” per hour for each hour 33 of approved training provided under the Contract. 34 35 1-07.12.GR1 36 Federal Agency Inspection 37 38 1-07.12.INST1.GR1 39 Section 1-07.12 is supplemented with the following: 40 41 1-07.12.OPT1.GR1 42 (October 3, 2023) 43 Required Federal Aid Provisions 44 The Required Contract Provisions Federal Aid Construction Contracts (FHWA 1273) 45 Revised October 23, 2023 and the amendments thereto supersede any conflicting 46 provisions of the Standard Specifications and are made a part of this Contract; provided, 47 however, that if any of the provisions of FHWA 1273, as amended, are less restrictive 48 than Washington State Law, then the Washington State Law shall prevail. 49 50 The provisions of FHWA 1273, as amended, included in this Contract require that the 51 Contractor insert the FHWA 1273 and amendments thereto in each subcontract, together 52
