41 ORDINANCE NO 2175 . An Ordinance providing for the improvement of the alley between 21st and 22nd Streets and Colby and `V`ietmore Avenues, by grading alley full width, and slagging twelve feet wide and six inches thick and doing all other work necessary in connection therewith to make a complete improvement, creating an assessment district , creat- ing a Local Improvement District Fund therefor, and providing that payment for said improvement be made by special assessment on the property in said District under the mode of payment by bonds, Whereas, a majority petition of the property owners, petitioning for said improvement , has heretofore been filed with the Commissioner of Public Works and said Commissioner has found the things set forth in said petition to be true, and, Whereas , said Commissioner of Public Forks has filed with the City Council all data and information, es required by law, and, • Whereas, said Commissioner of Public forks has recommended to the City Council that said improvement petitioned for be made, and it appearing to the City Council that public convenience and necessity requires such improvement to be made, now therefor, TAM, CITY OF EVERETT DOES ORDAIN : Section 1 ; That the alley between 21st and 22nd Streets and Colby and Wetmore Avenues be improved by grading alley full width, and slagging twelve feet wide and six inches thick and doing all other vno rk necessary in connection therewith to make a complete improvement according- to the, plans and specifications, prepared under the direction of the City Engineer,which plans and specifications are hereby adopted and aooroved. Section 2 : That the cost and expense of such improvement including all necessary incidental expenses shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. She City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement .
