4 I <br /> ORDINANCE NO. 2369-99 <br /> AN ORDINANCE relating to Criminal Attempt, amending section 28 of Ordinance <br /> 1145-85 (EMC 10.10.010). <br /> WHEREAS, the crime of Criminal Attempt under the City's Criminal Code criminalizes <br /> only those attempts to commit crimes under the City Code, and not attempts to commit <br /> crimes under state law; and <br /> WHEREAS, the City of Everett City Council deems it appropriate for the City's Criminal <br /> Code to be consistent with state law in regard to the crime of Criminal Attempt. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 28 of Ordinance 1145-85 (EMC 10.10.010), which reads as <br /> follows: <br /> Criminal attempt. <br /> A. A person is guilty of an attempt to commit an offense if, with intent to commit a <br /> specific offense under the ordinances of the city, he does any act which is a substantial <br /> step toward the commission of that offense. <br /> B. If the conduct in which a person engages otherwise constitutes an attempt to <br /> commit an offense, it is no defense to a prosecution of such attempt that the offense <br /> charged to have been attempted was, under the attendant circumstances, factually or <br /> legally impossible of commission. <br /> C. An attempt to commit an offense is a misdemeanor. <br /> is hereby amended to read as follows: <br />
