/111104147""A <br /> viirritY <br /> 7...1 <br /> ORDINANCE NO. 2371-99 <br /> An Ordinance Rezoning Two Small Areas Located on the North Side of 79th Street SE, <br /> West of Evergreen Way, to Correct a Minor Building Encroachment, <br /> as Part of the Annual Update to the Comprehensive Plan Initiated in 1998. <br /> WHEREAS,the City of Everett adopted a new Comprehensive Plan in August, 1994, in <br /> conformance with the Washington State Growth Management Act; and <br /> WHEREAS,the Growth Management Act, codified as RCW Chapter 36.70A, generally <br /> allows for comprehensive plans to be amended on an annual basis; and <br /> WHEREAS,the City of Everett initiated its fourth annual comprehensive plan <br /> amendment process in July, 1998, which included consideration of Land Use Map <br /> amendment and rezone applications; and <br /> WHEREAS,the Everett School District applied for a rezone of two areas located on the <br /> common boundary between the Evergreen Middle School and Revord Motors, from R-1 <br /> (Single Family)to C-1 (General Commercial) for one area, and from C-1 (General <br /> Commercial)to R-1 (Single Family),to allow for a boundary line adjustment; and <br /> WHEREAS,the City Council has adopted Ordinance No.2370-99 amending the land <br /> use designation of the Everett Comprehensive Plan for the subject properties in support <br /> of the proposed rezone; and <br /> WHEREAS,the City Council finds: <br /> 1. The proposed rezoning is necessary to implement the land use designations of the <br /> City's Growth Management Comprehensive Plan; <br /> 2. By implementing the Comprehensive Plan land use designation, the proposed <br /> zoning bears a substantial relation to the public health, safety and welfare; and <br /> 3. The rezone promotes the best long term interests of the Everett community. <br />
