4 40 <br /> apply to any legally ordained clergyman, priest or rabbi actually <br /> engaged in ministering to a religious congregation in this city in <br /> so far as the said clergyman, priest or rabbi is keeping intoxicating <br /> liquors for the purpose of administering the same for sacramental <br /> purposes. <br /> Section 10 : In any prosecution nder this ordinance, the <br /> possession of intoxicating liquor shall be prima facie evidence that <br /> said. liquor was kept unlawfully and it shall not be necessary for the <br /> complaint to set forth any negative allegation nor for the plaintiff <br /> to prove that the defendant does not come within any of the exceptions <br /> provided by law but such exceptions shall be considered as a matter <br /> of defense and the burden shall be upon defendant to show that he <br /> comes within such exceptions. <br /> Section 11 : it shall be unlawful for any person other <br /> than a common carrier, registered pharmacist, clergyman, priest or <br /> rabbi to transport, move about, carry within or bring into the City <br /> of Everett any intoxicating liquor whatsoever. <br /> Section 12 : It shall be unlawful for any person to make <br /> a false statement to a physician, druggist or pharmacist, for the <br /> purpose of obtaining intoxicating liquor or alcohol, or to any <br /> railroad, express or transportation company or any person engaged <br /> in the business of transporting goods, wares and merchandise for <br /> the purpose of obtaining the shipment, transportation or delivery <br /> of any intoxicating liquor. <br /> Section 13 : If any section of this ordinance or any part <br /> of any section shall be held invalid, all other sections and parts <br /> of sections which are not expressly held to be invalid, shall <br /> continue in full force and effect. <br /> Section 14 : 0rdinamces No.1695, 1723, 1834,1852 and. 2069 <br /> are hereby repealed. <br />
