Assistants and inspectors have the <br />authority to reject defective material and suspend Work that is being done improperly, subject to <br />the final decisions of the Owner’s Representative or, when appropriate, the Owner. <br />Assistants and inspectors are not authorized to accept work, to accept materials, to issue <br />instructions, or to give advice that is contrary to the Contract. Work done or material furnished <br />which does not meet the Contract requirements shall be at the Contractor’s risk and shall not be <br />a basis for a Contract Claim even if the Owner’s Representative, inspectors or assistants <br />purport to change the Contract. <br />Assistants and inspectors may advise the Contractor of faulty Work or materials or <br />infringements of the terms of the Contract; however, failure of the Owner’s Representative or <br />the assistants or inspectors to advise the Contractor does not constitute acceptance or <br />approval. <br />The Contractor shall submit supplemental working or detail drawings as required for the <br />performance of the Work pursuant to 2.4. SUBMITTALS. Except as noted, all drawings and <br />other Submittals shall be delivered directly to the Owner’s Representative. The drawings shall <br />be on sheets measuring 22 by 34 inches, 11 by 17 inches, on sheets with dimensions in <br />multiples of 8 1 /2 by 11 inches, or other size approved by the Owner consistent with the Work <br />to be detailed. Contractor shall provide drawings far enough in advance of ordering or <br />installation to allow for review by the Owner’s Representative or other agencies and possible <br />resubmittal and further review after resubmittal. After a plan or drawing has been reviewed and <br />returned to the Contractor, all changes proposed by the Contractor may be submitted to the <br />Owner’s Representative for review and comment. <br />The Contractor shall obtain the Owner’s Representative’s written acknowledgement of approved <br />Submittals before proceeding with the Work represented by the Submittal. Such review does not <br />impose any responsibility upon the Owner, nor does it relieve the Contractor of any <br />responsibility for the accuracy of the Submittal or its conformity with the Contract. The <br />Contractor shall bear all risk and all costs of any Work delays caused by resubmittal or <br />correction of Submittals. The Contractor shall allow sufficient time for Owner’s review of <br />Submittals and possible corrections by the Contractor so as not to delay the Work. <br />The Contractor’s Bid price shall include all costs of all Submittals, including, but not limited to, <br />working, detail and shop drawings. <br />4. CONTRACTOR <br />4.1. CONTRACTOR'S REPRESENTATIVE <br />The Contractor shall notify the Owner in writing of the name of the person who will act as the <br />Contractor's representative and shall have the authority to act in matters relating to this <br />Contract. This person shall have authority to carry out the provisions of the Contract and to <br />supply materials, Equipment, tools and labor without delay for the performance of the Work. <br />Contractor shall employ and keep on Site on a full time basis personnel experienced in the <br />management of construction of projects of this size and type. These shall include, but not be <br />limited to, a project manager and superintendent. Neither the Contractor’s project manager nor <br />the superintendent shall have supervisory responsibility for other Projects for the Contractor <br />while assigned to this Project. Contractor shall employ and assign such additional, full time <br />office, support and engineering personnel to support the project manager and superintendent <br />and allow timely completion of the Project. The project manager and superintendent shall be <br />approved by the Owner, and such approval shall not be unreasonably withheld. Contractor
