City of Everett 00 7200 - 2 <br /> <br /> <br />General Conditions <br />007200-2 202082-10 May 2024 <br />pw://Carollo/Documents/WA/Everett/202082-100000/04 Design/04 Specs/Carollo/007200 (FS-100) <br /> <br />due to Extra Work, inefficiencies, Delays, interferences, and problems with the design. Contract <br />Claim includes, but is not limited to, claims or requests by Subcontractors for extensions of <br />Contract Time, adjustment of Contract Sum, additional compensation that the Contractor <br />attempts to pass through or assert against the Owner, or claims against the Owner arising out of <br />a third party’s claim against the Contractor. <br />Contract Sum: The price in dollars stated in the Contract to be paid by the Owner to the <br />Contractor for the Work described in the Contract Documents, as modified by any Change <br />Orders. <br />Contract Time: The duration of the Project as stated in the Contract and as modified by any <br />Change Orders. <br />Contractor: The individual or entity with whom Owner has entered into the Agreement. <br />Day: Calendar day, unless explicitly stated otherwise. <br />Delay: Any increase of the duration of the critical path of the Project. <br />Dispute: Any controversy or disagreement. <br />Drawings: That part of the Contract Documents that graphically shows the scope, extent, and <br />character of the Work to be performed by Contractor. Shop Drawings and other Contractor <br />Submittals are not Drawings as so defined. <br />Effective Date of Agreement: See 18.10 EFFECTIVE DATE. <br />Engineer: An individual or entity retained by the Owner to be the Owner’s representative with <br />regard to matters of design intent. The terms “Owner’s Representative”, “Engineer” and <br />“Architect” are interchangeable. <br />Equipment: Mechanical, electrical, instrumentation, or other devices with one or more moving <br />parts, or devices requiring an electrical, pneumatic, electronic, or hydraulic connection. <br />Extended Overhead: The increase in Overhead costs attributable to an extension of Contract <br />Time. <br />Extra Work: Providing materials and Equipment and the performance of Work not directly <br />called for in, or implied by, the Contract Documents, such that Contractor would be entitled to an <br />adjustment of Contract Sum and possibly an extension of Contract Time. <br />Field Order: A written order issued by Owner’s Representative that requires minor changes in <br />the Work, but does not involve a change in the Contract Sum or the Contract Time. <br />Final Acceptance: Formal action by Everett City Council determining that all of the Contractor's <br />Work has been completed, except for any landscaping maintenance. <br />Float: The amount of time between the early start date and the late start date, or the early finish <br />date and the late finish date of any activity in the project schedule. <br />Force Account: Costs of performing Work as defined in 9.6. FORCE ACCOUNT. <br />Furnish, Install, Perform, Provide, Supply: The word "Furnish" or the word "Install" or the <br />word "Perform" or the word "Provide" or the word "Supply," or any combination or similar <br />directive or usage thereof, shall mean furnishing and incorporating in the Work including all <br />necessary labor, materials, equipment, and everything necessary to perform the Work indicated, <br />unless specifically limited in the context used. <br />General Conditions: This Section 007200 of the Contract Documents. <br />May: Conduct that is permitted, but not required.
