City of Everett 00 7200 - 7 <br /> <br /> <br />General Conditions <br />007200-7 202082-10 May 2024 <br />pw://Carollo/Documents/WA/Everett/202082-100000/04 Design/04 Specs/Carollo/007200 (FS-100) <br /> <br />Reference to standards, specifications, manuals, or codes of any technical society, <br />organization, or association, or to Laws or Regulations, whether such reference be specific or <br />by implication, shall mean the standard, specification, manual, code, or Laws or Regulations in <br />effect at the time of opening of Bids (or on the Effective Date of the Agreement if there were no <br />Bids), except as may be otherwise specifically stated in the Contract Documents. <br />No provision of a standard, specification, manual or code, or an instruction of a Supplier shall be <br />effective to change the duties or responsibilities of Owner, Contractor, or Owner’s <br />Representative, or their Subcontractors, consultants, agents, or employees from those set forth <br />in the Contract Documents. No such provision or instruction shall be effective to assign to <br />Owner, or Owner’s Representative, or their related entities, any duty or authority to supervise or <br />direct the performance of the Work or any duty or authority to undertake responsibility <br />inconsistent with the provisions of the Contract Documents. <br />2.2. DIVISION OF SPECIFICATIONS AND DRAWINGS <br />Specifications and Drawings are divided into groups for convenience. These divisions are not <br />for the purpose of apportioning Work or responsibility for Work among Subcontractors, <br />Suppliers and manufacturers. The Contractor is responsible for all Work shown or described, <br />regardless of location(s) in the Contract Documents. <br />2.3. DISCREPANCIES IN SPECIFICATIONS AND DRAWINGS <br />2.3.1. Errors and Omissions <br />If the Contractor, in the course of the Work, becomes aware of any errors or omissions in the <br />Contract Documents or in the Owner's field work, he or she shall immediately inform the <br />Owner’s Representative in writing. The Owner’s Representative will promptly review the matter <br />and if he or she finds an error or omission has been made, then he or she will determine the <br />corrective actions and advise the Contractor accordingly. If the corrective work associated with <br />an error or omission significantly increases or decreases the amount of Work called for in the <br />Contract, the Owner will issue an appropriate Change Order. After discovery by the Contractor <br />of an error or omission, related work performed by the Contractor shall be done at its risk unless <br />authorized by the Owner’s Representative and approved by the Owner. Omissions from the <br />Drawings or Specifications or the misdescription of details of Work that are manifestly <br />necessary to carry out the intent of the Drawings and Specifications, or that are customarily <br />performed, shall not relieve the Contractor from performing such omitted or misdescribed details <br />of the Work, but they shall be performed as if fully and correctly set forth and described in the <br />Drawings and Specifications. <br />2.3.2. Conflicting Provisions <br />Figure dimensions on drawings shall govern over scale dimensions and detail drawings shall <br />govern over general drawings. In the event an item of Work is described differently in two or <br />more locations on the Drawings and in the Specifications, the Contractor shall, upon request of <br />the Owner’s Representative, submit in writing to the Owner’s Representative the description <br />upon which the Contractor relied in preparing its Bid or laying out the Work. If the Owner’s <br />Representative directs the Contractor to perform Work in a manner other than that <br />contemplated by the Contractor in preparing its Bid or laying out the Work, Change Order <br />procedures will be followed. In this event, the Contractor shall submit to the Owner’s <br />Representative such supporting information, including bidding or layout documents, as may <br />reasonably be necessary for the Owner’s Representative to determine whether the Contract <br />Sum is increased, decreased or unchanged by the Change Order.
