Utilities <br />2.3.3.1 General <br />The Owner has endeavored to determine the existence of utilities at the Site of the Work from <br />the records of the owners of known utilities in the vicinity of the Work. The positions of these <br />utilities as derived from such records are shown on the Drawings. No excavations were made to <br />verify the locations shown for underground utilities. The service connections to these utilities are <br />not shown on the Drawings. It shall be the responsibility of the Contractor to determine the exact <br />location of utilities and service connections thereto. Such field verification must be performed in <br />sufficient time so as not to impede the progress of the Work or fabrication of materials to be <br />incorporated into the Work. The Contractor shall call the Utility Location Request Center (one <br />call center) for location of utilities in the field not less than two (2) nor more than (10) ten <br />business days before the scheduled date of commencement of excavation. The Contractor shall <br />make its own investigations, including exploratory excavations, to determine the locations and <br />type of existing utilities, including service connections, prior to commencing work that could <br />result in damage to such utilities. The Contractor shall immediately notify the Owner’s <br />Representative as to any utility discovered by him in a different position than shown on the <br />Drawings or which is not shown on the Drawings. No excavation shall begin until all known <br />facilities in the excavation areas have been marked. Contractor shall coordinate its activities <br />with the utility provider. Contractor shall bear the cost of maintaining utility service. <br />The Contractor should be aware of, and comply with, Chapter 19.122 RCW, a law relating to <br />underground utilities. The Owner shall not pay Contractor any of Contractor’s cost of complying <br />with this law, or repairing or indemnifying any damage or injury arising out of Contractor’s failure <br />to comply with this law. <br />Owner does not represent or warrant who may be obligated to pay for the cost of relocation or <br />temporary maintenance of the utility. Contractor shall investigate whether such cost must be <br />borne by the owner of the utility. <br />Governmental agencies and owners of utilities reserve the right to enter upon streets, alleys, <br />rights-of-way, or easements for the purpose of making changes in their property made <br />necessary by the Work and for the purpose of maintaining and making repairs to their property. <br />2.3.3.2 Known Utilities <br />The Contractor shall provide at its sole expense all labor, equipment, materials and services <br />necessary to remove, relocate, or maintain utilities specified on the Drawings. The work on each <br />utility shall be performed in a manner satisfactory to the utility owner. The utility owner has the <br />option of doing such work with its own forces at the Contractor's expense, or permitting the work <br />to be performed by the Contractor. <br />2.3.3.3 Service Connections <br />Locations of service connections are not identified on the Drawings. The Contractor shall <br />provide at its sole expense all labor, equipment and material to remove, relocate or maintain <br />service connections. Work on service connections shall be performed in a manner satisfactory <br />to the service connection owner. The service connection owner has the option of doing such <br />work with its own force at the Contractor's expense, or permitting the work to be performed by <br />the Contractor. <br />2.3.3.4 Unknown Utilities <br />When a utility interferes with the Work and is either (1) not identified on the Drawings or (2) <br />located in a position significantly different from that specified on the Drawings, Contractor shall <br />follow the procedures of ARTICLE 11. DIFFERING SITE CONDITIONS. Interference with the <br />Work is defined as a utility that crosses or projects into the plane of the Work at an elevation
