City of Everett 01 25 00 - 4 <br /> <br /> <br />01 25 00 - 4 SUBSTITUTION PROCEDURES <br /> <br />concerning "substitutions" for the selection of a matching product in another <br />product category. <br />7. VISUAL SELECTION: Where specified product requirements include the phrase <br />"...as selected from the manufacturer's standard colors, patterns, textures..." or <br />similar phrases, select a product and manufacturer that complies with other <br />specified requirements. Architect will select the color, patterns and texture from <br />the product line selected. <br />1.7 SUBSTITUTIONS <br />A. GENERAL: If the Contractor desires approval of some material or product other than <br />that specified, he may submit a written request for approval of the substitute item in <br />accordance with the following requirements. <br />1. All such requests shall be submitted in four (4) copies and must be made on the <br />"Substitution Request Form", see Section 006325 Substitution Request Form. <br />2. No request for approval will be considered unless submitted in accordance with <br />this Section. <br />3. Final decision as to whether an item is an equal or satisfactory substitution rests <br />with the Owner. <br />B. REQUESTS FOR APPROVAL: Every request for approval must state whether the item <br />offered is an equal or better substitution. Each request for substitution must be <br />referenced to the related specification section and drawing numbers, and be complete <br />with product data/drawings, description of methods, technical and other information. If <br />applicable, include samples showing comparison or physical and other pertinent <br />characteristics as required to establish equivalence of acceptability for the proposed <br />application. Where specific a test results are required by the contract documents, the <br />comparison data for the proposed item shall be based upon the same test methods as <br />those specified, or they shall be correlated to clearly demonstrate comparability. The <br />same warranty described for the specified product is required for the substitution. <br />C. DURING BID PERIOD: Request for substitutions will not be considered during the bid <br />period. <br />D. AFTER RECEIPT OF BID: Requests for approval of alternative materials or products <br />will be considered by the Owner for a period of sixty (60) calendar days following date of <br />"Notice To Proceed". Within ten (10) calendar days of receipt of Contractor's request for <br />substitution, the Owner will request whatever additional information or documentation <br />may be needed for his evaluation of the request. Within twenty (20) calendar days of <br />receipt of request, or within one week of receipt of requested additional information or <br />documentation (whichever is later), the Owner will notify the Contractor of either his <br />acceptance or his rejection of the proposed substitution. In submitting a request for <br />substitution, the Contractor agrees to the following: <br />1. That the Contractor has personally investigated the proposed substitute product or <br />material and determined that it is equal or superior in all respects to that specified. <br />2. That the Contractor shall provide the same warranty for the substitution as he <br />would for that specified. <br />3. That the Contractor will coordinate all trades, including changes thereto as may be <br />required, that he waives all claims for additional costs which subsequently become
