Chapter 19.04 EMC, Definitions Page 18 of 55 <br />The Everett Municipal Code is current through Ordinance 4031-24, passed May 22, 2024. <br />Setback, Front. “Front setback” means the required minimum distance between the front lot line <br />and any structure, building or use. <br />Setback, Rear. “Rear setback” means the required minimum distance between the rear lot line <br />and any structure, building or use. <br />Setback, Side (Interior). “Side (interior) setback” means the required minimum distance between <br />the side lot line which does not abut a street and any structure, building or use. <br />Setback, Side (Street). “Side (street) setback” means the required minimum distance between the <br />side lot line abutting the street on a corner lot and any structure, building or use. (Ord. 3774-20 <br />§ 5(D) (Exh. 3), 2020.) <br />19.04.050 Use definitions, residential. <br />This section defines uses set forth in Table 5-1 in EMC 19.05.080. <br />“Adult family home” has the same meaning as RCW 70.128.010, which means a residential <br />home in which a person or persons provide personal care, special care, room, and board to <br />more than one but not more than six adults who are not related by blood or marriage to the <br />person or persons providing the services. An adult family home may provide services to up to <br />eight adults upon approval from the department under RCW 70.128.066. <br />“Assisted living facility” means a residential facility for elderly persons (age fifty-five or older) <br />who require moderate to extensive assistance with daily tasks such as cooking, eating, bathing, <br />housekeeping, dispensing of medicines, shopping, appointments and other tasks. <br />“Congregate care facility” means a residential facility for the elderly. The minimum age limit for <br />the elderly is fifty-five years for the residents, with younger spouses permitted. The facility <br />typically has a central lobby, common dining area, hobby and/or recreational rooms. The fee <br />structure shall include at least one meal per day in the common dining area. Accessory support <br />uses for the tenants, such as pharmacies, banking service, etc., may be included. <br />“Day care, family home” means day care provided in the home as an incidental use to the <br />principal residential use of the property, for up to twelve children full time, or six adults full <br />time, or as otherwise provided by the state of Washington.
