AGREEMENT BETWEEN <br />LIFE SCAN WELLNESS CENTERS <br />AND <br />LAW ENFORCEMENT OFFICERS AND FIREFIGHTERS <br />HEALTH & WELFARE TRUST <br />PARTICIPATING EMPLOYER <br /> THIS AGREEMENT is made between City of Everett, a Washington municipal <br />corporation, a contributing employer to the LEOFF Trust (hereinafter the "Employer"), and <br />Life Scan Wellness Centers (hereinafter “Life Scan"). <br /> WHEREAS, the Law Enforcement Officers and Firefighters Health and Welfare Trust <br />(“LEOFF Trust”) and Life Scan have entered into a Professional Services Agreement dated on <br />or about October 4, 2021, as amended (hereinafter “PSA”) to provide annual NFPA 1582/1583 <br />physicals for eligible LEOFF participants; <br /> WHEREAS, the PSA provides that the LEOFF will compensate Life Scan for each NFPA <br />1582/1583 physical performed; <br /> WHEREAS, the PSA provides that Life Scan and the Employer will mutually agree to a <br />time and place to perform the NFPA 1582/1583 physicals; <br />NOW THEREFORE, in furtherance of the above, the Parties agree to the following: <br />1.Life Scan will perform 45 NFPA 1582/1583 physicals at 2801 Oakes Ave., <br />Everett, WA 98201 between September 30 and October 4, 2024. Employer agrees to <br />communicate the availability of the NFPA 1582/1583 physicals to its employees and to <br />identify to Life Scan all employees that will be receiving an NFPA 1582/1583 physical. <br />Except for Section 2 below, LifeScan’s work under this Agreement is at no cost to Employer. <br />2. Employer agrees that it will be financially responsible for the cost of the NFPA1582 <br />physical if: (1) a LEOFF participant employed by the Employer fails to appear for his or her <br />NFPA 1582/1583 physical and (2) after being provided an opportunity to reschedule, is either <br />non-responsive to the request to reschedule or fails to appear at the rescheduled time slot. This <br />Section 2 does not apply to persons not currently on the Employer’s payroll (for example, this <br />Section 2 does not apply to LEOFF retirees). The Employer is not responsible for any costs <br />related to such non-payroll persons. LifeScan is responsible for collecting costs, if any, directly <br />from non-payroll persons. <br />3.Sections VI, VIII, IX, X, XI, XII, XIII, and XV of the PSA are incorporated into <br />this Agreement as if fully set forth herein, with “Employer” substituted for “LEOFF” and <br />“Snohomish” substituted for “Spokane” for those Sections incorporated into this Agreement.
