compensated as equals, consistent with the following: <br /> <br />1. Employees are “similarly employed” if the individuals work for the same employer, the <br />performance of the job requires comparable skill, effort, and responsibility, and the jobs <br />are performed under similar working conditions. Job titles alone are not determinative <br />of whether employees are similarly employed; <br /> <br />2. The Agency may allow differentials in compensation for its workers if the differentials <br />are based in good faith and on any of the following: <br /> <br />a. A seniority system; a merit system; a system that measures earnings by quantity <br />or quality of production; a bona fide job-related factor or factors; or a bona fide <br />regional difference in compensation levels. <br /> <br />b. A bona fide job-related factor or factors may include, but not be limited to, <br />education, training, or experience that is: Consistent with business necessity; not <br />based on or derived from a gender-based differential; and accounts for the entire <br />differential. <br /> <br />c. A bona fide regional difference in compensation level must be: Consistent with <br />business necessity; not based on or derived from a gender-based differential; and <br />account for the entire differential. <br /> <br />This contract may be terminated by the City, if the City, Snohomish County, the Washington <br />State Department of Enterprise Services, or the Washington State Department of Commerce <br />determines that the Agency is not in compliance with this provision. <br /> <br /> <br />VIII. PROJECT MANAGEMENT <br /> <br />A. Lead-Based Paint <br /> <br />The Agency must comply with the Lead-Based Paint Poisoning Prevention Act (42 U.S.C. <br />§§ 4821-4846), the Residential Lead-Based Paint Hazard Reduction Act of 1992 (42 <br />U.S.C. §§ 4851-4856), and implementing regulations at 24 CFR part 35, subparts A, B, <br />M, and R, which apply to activities under this Contract. <br /> <br />B. Housing Standard <br />Permanent housing receiving funding under this Contract must meet the habitability <br />standards in accordance with Consolidated Homeless Grant (CHG)/System <br />Demonstration Grant (SDG) guidelines. <br /> <br />C. Coordinated Entry System <br /> <br />The Agency shall use the Coordinated Entry system established by the <br />Everett/Snohomish County Continuum of Care as required by the Department of Housing <br />and Urban Development (HUD) CoC Program Coordinated Entry Requirements and <br />guidelines as described in the Consolidated Homeless Grant (CHG)/System <br />Demonstration Grant (SDG) guidelines. <br />
