On-site Stormwater Management BMPs: <br /> ❑ Post-Construction Soil Quality and Depth ❑ Sheet Flow Dispersion <br /> ❑ Full Dispersion ❑ Concentrated Flow Dispersion <br /> ❑ Downspout Full Infiltration ❑ Rainwater Harvesting <br /> ® Rain Garden ❑ Vegetated Roof <br /> ❑ Bioretention ❑ Retained Trees <br /> ❑ Downspout Dispersion System ❑ Planted Trees <br /> ❑ Perforated Stub-Out Connection ❑ Retained Vegetation Areas <br /> ❑ Permeable Pavement <br /> 3. City Right of Entry. In accordance with chapter 14.28 EMC, including <br /> without limitation EMC 14.28.120(B) and EMC 14.28.150, the City is authorized at all <br /> reasonable times to enter in or upon the Property for the purpose of investigating or <br /> inspecting the Stormwater BMPs, or any condition relating to the provisions in chapter <br /> 14.28 EMC and for such other purposes as provided in chapter 14.28 EMC. The Grantor <br /> hereby grants an easement over the Property to the City for such purposes. <br /> 4. Enforcement. In accordance with chapter 14.28 EMC, including without <br /> limitation EMC 14.28.150.D, the Director of Public Works may issue an enforcement order <br /> or other orders to the Grantor to maintain or repair Stormwater BMPs and, if the order is <br /> not adhered to, the City may provide such actions as needed to repair, restore or <br /> maintain the Stormwater BMPs, with the City receiving reimbursement in accordance <br /> with EMC 14.28.150.D.5. Additionally, as set forth in EMC 14.28.150.D.4, if at any time <br /> the City determines that the Stormwater BMPs creates any imminent threat to public <br /> health or welfare, the City may take immediate measures to remedy the threat, with the <br /> City receiving reimbursement in accordance with EMC 14.28.150.D.5. This section does <br /> not limit any authority the City may have at any time to take other enforcement action <br /> under chapter 14.28 EMC or other applicable law. <br /> 5. General Provisions. <br /> A. Binding Effect. The rights and obligations of the Grantor under this <br /> Covenant run with the land and inure to the benefit of the public and City and the City's <br /> successors, and are binding upon Grantor, its successors and assigns and each and every <br /> person who at any time has any ownership interest in the Property. <br /> B. Complete Agreement. This Covenant constitutes the entire <br /> agreement of Grantor and the City relating to the subject matter of this Covenant.
