11lirr 40 1 Office at Everett, Washington. 2 Sec . 2: That all the lands, premises, and other property 3 within the limits described in Section 1 herein, be and the 4 same are hereby condemned and appropriated to the public use , 5 for the purpose of public streets and highways forever , and 6 that all the lands, rights, privileges and other property 7 adjoining or approximate to said limits which are necessary 8 to be taken, used or damaged in said opening and establish- 9 ment , be and the same are hereby condemner: and appropriated 10 to the public use for the purpose of making such opening and 11 establishment as aforesaid. Said lands, rights and privileges 12 and other property are to be taken and appropriated only after 13 just compensation has been made or paid into court for the 14 owner or other persons entitled thereto in the manner provided 15 by law. 16 17 Sec. 3 : That the City Attforney, be and he is hereby 13 authorized and directed to file in the Superior Court of the 19 State of Washington, in and for the County of Snohomish, in 20 the name of Everett , a municipal corporation, a petition• cor- 21 plying with the requirements of the laws of the State of Wash.- 22 ington, and praying that just compensation to be made for the 23 lands and other property and property rights to be taken or 24 I damaged by the opening and establishing: of Broadway and the 25 said portion of the pacific Highway, as provided herein, be 26 ascertained by a jury or by the court in case a jury be waived. 27 Sec . 4: Assessments shall be made and levied in the 28 manner provided by law, for the purpose of raising the amount 29 necessary to pay the compensation and damages which shall be 30 awarded for the property taken or damaged as aforesaid, to- 31 (3)
