3. The PD overlay zone can be amended to simplify the procedures associated with <br /> establishing and implementing a Planned Development Overlay Zone, without <br /> sacrificing the protections to the public or reducing the opportunities for public <br /> participation in the establishment of the Planned Development Overlay Zone for a <br /> specific property; and <br /> 4. City staff has recommended some revisions to the Planned Development Overlay <br /> Zone and the Rezone procedures of the Everett Zoning Code to make the use of the <br /> Planned Development Overlay Zone more feasible, and to give the City greater <br /> authority to apply conditions and restrictions to property as part of the rezone process; <br /> and <br /> 5. The amendments proposed to the Zoning Code are consistent with the Everett <br /> Comprehensive Plan; bear a substantial relation to public health, safety or welfare; <br /> and promote the best long term interests of the Everett community. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: Section 29.020 of Ordinance No. 1671-89 (EMC 19.29.020), as amended, <br /> which reads as follows: <br /> 29.020 Review process. All proposals for a PD planned development overlay zone shall <br /> be reviewed using Review Process VB, and shall be treated as a performance agreement <br /> rezone in accordance with subsection 41.160.D of this title. <br /> Is hereby amended to read as follows: <br /> 29.020 Review process. All proposals for a PD planned development overlay zone <br /> shall be reviewed using Review Process V. If the proposed Planned Development <br /> overlay zone involves a specific site development plan indicating actual locations of <br /> buildings and other site improvements, it shall be treated as a performance agreement <br /> rezone in accordance with subsection 41.160.D of this title. If the Planned Development <br /> overlay zone does not involve a specific site development plan indicating actual locations <br /> of buildings and other site improvements, it shall be considered a non-project rezone as <br /> provided in subsection 41.160.D of this Title,rather than a performance agreement <br /> rezone. <br /> Section 2: Section 29.060 of Ordinance No. 1671-89 (EMC 19.29.060), as amended, <br /> which reads as follows: <br /> 29.060 Hearing-Determination. <br /> A. The planning commission shall make its decision on the planned development <br /> proposal based upon all information presented at the public hearing. <br />
