in violation of IPMC 106.1 and the international Residential Code (IRC) R105.1 and the location <br /> of the accessory building in the required setback is a violation of EMC 19.06.020 and 19.08.110, <br /> which reads: <br /> EMC 19.06.020 Building setbacks/building placement standards <br /> E. Building Setbacks for Residential Accessory Structures in Residential Zones. The <br /> following setback requirements apply to all buildings which are accessory to residential uses in all <br /> residential zones: <br /> Table 6-3: Setbacks for Accessory Buildings(Attached and Detached)in Residential Zones <br /> MINIMUM <br /> STANDARD: <br /> SETBACK: <br /> Side, interior a) See Table 6-2. <br /> b) Accessory buildings shall not be located within the interior side setback area, <br /> unless the side lot line abuts an alley, in which case there shall be no required <br /> side setback from the alley. <br /> EMC 19.08.110 Residential accessory buildings <br /> The following requirements apply to all buildings which are accessory to residential uses in the R-S, R-1, <br /> R-2, or R-2(A)zones: <br /> A. Accessory buildings or uses may not be established until the principal dwelling or dwellings are <br /> constructed on the lot. <br /> B. Use of Accessory Buildings. <br /> 1. Detached accessory buildings are limited to accessory uses. <br /> 2. The following spaces are allowed within a detached accessory building:bathrooms, hobby <br /> rooms, home occupations,home offices,recreation rooms, or laundry rooms. The following rooms are <br /> not allowed in accessory buildings: bedrooms, dining rooms, or kitchens. (See <br /> EMC 19.08.100 regarding accessory dwelling units.) <br /> IPMC 106.1 Unlawful acts, which reads: <br /> It shall be unlawful for a person,firm or corporation to be in conflict with or in violation of any of the <br /> provisions of this code. <br /> !PMC 108.1.4 Unlawful Structure, which reads: <br /> An unlawful structure is one found in whole or in part to be occupied by more persons than permitted <br /> under this code,or was erected, altered or occupied contrary to law. <br /> IRC R105.1 Permits Required <br /> Any owner or owner's authorized agent who intends to construct, enlarge, alter, repair, move, demolish <br /> or change the occupancy of a building or structure, or to erect, install,enlarge, alter, repair,remove, <br /> convert or replace any electrical, gas, mechanical or plumbing system, the installation of which is <br /> regulated by this code, or to cause any such work to be performed,shall first make application to <br /> the building official and obtain the required permit. <br /> Notice and Order Page 2 of 5 <br />
