the liquid inside the catch basins for documentation purposes.The sample bottle revealed the liquid <br /> inside the stormwater catch basin was a pink automotive fluid that smelled strongly of petroleum <br /> products. SWM inspected the stormwater infrastructure downstream of the stormwater catch basin to <br /> document how far the spill had traveled.SWM observed that the spill had discharged down to the oil <br /> water separator, and the pink liquid was visible in all chambers of the oil water separator(forebay, <br /> middle chamber, and afterbay). SWM immediately contacted Nelson Petroleum to clean up the <br /> contaminated stormwater infrastructure. <br /> Three previous inspections in Year 2022 had revealed similar illicit discharge concerns, including: <br /> - September:another catch basin that looked to be full of a brown grease residue,and a fuel <br /> pump at the Pacific Pride Fuel Station (a tenant of Nelson Petroleum at this location)was leaking <br /> on to the ground. SWM observed a direct discharge to their stormwater system. <br /> - March:the catch basin on the west side of their fuel island area appeared oily/greasy with <br /> visible staining leading towards the catch basin.When SWM opened the storm drain,they <br /> observed that the liquid inside appeared dark as if it was oil.A sample was collected and <br /> revealed the liquid inside the stormwater catch basin was a dark black color and had a strong <br /> odor of petroleum products. <br /> - February: SWM investigated a complaint regarding petroleum contamination to a <br /> wetland/greenbelt that several businesses discharge to(including the Nelson Petroleum site). <br /> Prior to a field investigation of this water quality complaint, SWM discovered that there had <br /> been several instances in the past where petroleum contamination to this wetland/greenbelt <br /> had been directly linked to the bulk petroleum distribution site to the west(9826 7th Ave SE- <br /> formerly a different owner but presently owned and operated by Nelson Petroleum).Once <br /> SWM determined that a likely source of this contamination was the Nelson Petroleum site, <br /> SWM conducted a site inspection. Upon investigation,it was discovered that nearly every single <br /> stormwater asset on the site was heavily contaminated with petroleum products. Nearly every <br /> asset was full of an iridescent pink liquid.SWM immediately informed Nelson Petroleum of the <br /> illicit discharges to have them clean up the contaminated stormwater infrastructure. <br /> In recent months, the property owner has taken temporary steps to plug the private stormwater system <br /> to prevent discharge from leaving the property.The valve closure is a temporary spill containment <br /> method as designed.Any modifications of an existing stormwater drainage system must be approved <br /> and permitted by the City with a public works permit,which has not been submitted by the applicant. <br /> Engineering calculations,overflow,capacity, pumping and containment measures have also not been <br /> provided for City review and approval to evaluate the ability to protect the environment from future <br /> discharges or potential flooding as a result of the plug. <br /> The non-compliant and/or illicit connections associated with the fuel island on the property created or <br /> allowed illicit discharges of petroleum products into the stormwater system.The existing conditions, <br /> and unpermitted modifications to the Stormwater drainage system, are violations of Everett Municipal <br /> Code(EMC) 14.28.120 &14.28.130, 14.28.140,which read: <br /> • EMC 14.28.120 Maintenance and operations of private stormwater drainage systems <br /> Maintenance of private stormwater drainage systems and infrastructure is required to ensure <br /> the ongoing effectiveness of the facilities and the protection of life and property.All <br /> private stormwater drainage systems shall be maintained by the owner or operator thereof in a <br /> safe and proper operating condition,and in compliance with all applicable requirements of this <br /> chapter and regulations and procedures adopted hereunder.The city assumes no responsibility <br /> Notice and Order Page 2 of 6 <br />
