In accordance with EMC 19.43.230,the City published an EIS Addendum on July 9, <br /> 2024,to provide further information about the SEPA payments required to mitigate the financial <br /> costs of the services, equipment, and station described in Recitals F and G above, in order to <br /> ensure that adequate fire and police protection are available to serve the Park District. <br /> J. Based on the analysis in the FEIS and the EIS Addendum, and consistent with EMC <br /> 19.43.230 and EMC 19.43.240, the purpose of this Mitigation Agreement is to provide, pursuant <br /> to SEPA and the Interlocal Cooperation Act (chapter 39.34 RCW), for mitigation payments to <br /> address the impact of the Park District on City police and fire services. <br /> AGREEMENT <br /> The Parties agree as follows: <br /> SECTION 1: SEPA MITIGATION PAYMENTS <br /> EHA will make mitigation payments to the City as set forth in this Section 1 (collectively, <br /> "SEPA Mitigation Payments"): <br /> A. Calculation of SEPA Mitigation Payments. Beginning on the date of this Mitigation <br /> Agreement,and continuing for as long as this Mitigation Agreement is in effect, EHA will pay SEPA <br /> Mitigation Payments for each Park District Dwelling Unit as follows: <br /> Police SEPA Mitigation Payment Fire SEPA Mitigation Payment per <br /> Year per Park District Dwelling Unit Park District Dwelling Unit <br /> 2024 $103.06/year $126.92/year <br /> 2025 and Previous year's payment, Previous year's payment, increased <br /> each year increased in accordance with in accordance with Section 1.D.2 <br /> after Section 1.D.1 below below <br /> A "Park District Dwelling Unit" for this Mitigation Agreement is a residential unit in <br /> the Park District (such as, for example, an apartment unit or a townhouse)that has a <br /> final certificate of occupancy issued after the date of this Mitigation Agreement; <br /> provided, however, that a residential unit is not a "Park District Dwelling Unit" if it is <br /> occupied by a household whose income at initial occupancy (determined in a manner <br /> consistent with determinations of lower-income families under Section 8 of the <br /> United States Housing Act of 1937, as amended) does not exceed (a) 60%of area <br /> median gross income, adjusted for household size, or (b) if such unit is located within <br /> a qualified low-income housing project utilizing the average income test under <br /> Section 42(g)(1)(C) of the Internal Revenue Code of 1986, as amended,the applicable <br /> imputed income limitation for such unit designated under such section. The average <br /> of the imputed income limitations designated shall not exceed 60%of area median <br /> gross income. As two of many possible examples of(b): (Example 1): if a qualified <br /> low-income housing project has ten units, with eight units without income <br /> restrictions, one unit with an income limitation at 50%AMI, and a second unit with an <br /> income limitation at 70%AMI, then the two income restricted units will not be Park <br /> District Dwelling Units so long as they are occupied in accordance with their income <br />
