5. The Park District retail and civic uses, public open spaces, buildings, and streets will be <br /> compatible with the surrounding neighborhood. <br /> 6. The Park District, as developed over time, will meet or exceed the performance-based <br /> intent of the City's development standards in order to provide an exceptional residential <br /> and civic environment. <br /> 7. The elements of the Park District will respond to and balance the needs of Everett <br /> residents and visitors,the EHA,the City, and other public agencies. <br /> 8. The City and EHA determined that the Park District PDO is subject to the requirement for <br /> an Environmental Impact Statement (EIS) under the State Environmental Policy Act <br /> (SEPA). <br /> 9. The City assumed lead agency status for SEPA and agreed to EHA's recommendation for <br /> a consultant team to perform work on the EIS. <br /> 10. The City's Responsible Official issued a Determination Significance on February 1, 2023. <br /> 11. The City's Responsible Official issued a Draft EIS on October 25, 2023. <br /> 12. The City's Responsible Official issued a Final EIS on February 5, 2024, and a later <br /> addendum, which concerns mitigation of the City's costs for Park District police and fire <br /> service. <br /> O. This Agreement is entered into pursuant to RCW 36.70B.170 etseq and Titles 15 and 19 EMC. The <br /> intent of the parties is to describe in this Agreement the development standards and regulations <br /> that shall apply to, govern, and vest the development and use of the Property. This Agreement <br /> shall be construed in a manner that is consistent with applicable development standards and <br /> regulations adopted by the City, except as modified herein. <br /> AGREEMENT <br /> NOW,THEREFORE, in consideration of the mutual agreements contained herein,the receipt and <br /> sufficiency of which are hereby mutually acknowledged,the City and EHA hereby agree as follows: <br /> 1. PARK DISTRICT PROPERTY, PROJECT DESCRIPTION, PERMITTED USES <br /> A. Property Description. The Property is the subject of this Agreement. The Property <br /> consists of the real property described and depicted in the attached Exhibit A. <br /> B. Project Description. The Project is generally as described in the recitals above. <br /> C. Park District Permitted Uses. The uses permitted on the Property shall be those uses that <br /> are in accordance with Exhibit A.1 of the PDO Ordinance and all applicable law. <br /> 3 <br />
