ORDINANCE NO. 2388-99 <br /> An Ordinance Rezoning 10025, 10105, and 10127 19th Avenue SE <br /> From R-1 (Single Family Low Density)to B-2(B) (Office). <br /> WHEREAS, the City Council finds: <br /> 1. The subject rezone area is comprised of 3 lots containing a net land area of <br /> approximately 3.15 acres, located on the east side of 19 Avenue SE, between 100th <br /> Street SE and 102nd Street SE. <br /> 2. The subject properties are designated "Office"by the Land Use Map of the Everett <br /> Comprehensive Plan. <br /> 3. The Growth Management Act [RCW 36.70A.040(4)(d)] requires the City's develop- <br /> ment regulations to be consistent with and implement the Comprehensive Plan. <br /> 4. The B-2(B) zone is the implementing zone for the "Office" land use designation of <br /> the Comprehensive Plan. <br /> 5. The Resolution of Intent to rezone 10127 19th Avenue SE expired in 1996. <br /> 6. The City has never taken action to rezone 10025 or 10105 19th Avenue SE, and the <br /> City's Zoning Map incorrectly shows that the two lots are the subject of a Resolution <br /> of Intent to Rezone to B-2(B). <br /> 7. The Hearing Examiner has conducted a public hearing on the proposed rezoning of <br /> the subject properties and has recommended that the zoning of the subject properties <br /> be changed from R-1 (Single Family Low Density) to B-2(B) (Office). <br /> 8. No development is proposed as part of the subject rezone. <br /> WHEREAS,the City Council concludes: <br /> 1. Rezoning the subject 3 lots from R-1 (Single Family Low Density) to B-2(B) (Office) <br /> is consistent with and implements the land use designation of the Comprehensive <br /> Plan. <br /> 2. By implementing the Comprehensive Plan,the proposed rezone bears a substantial <br /> relation to public health, safety or welfare; and the proposed rezone promotes the best <br /> long term interests of the Everett community. <br />
