CITY OF EVERETT WEST MARINE VIEW DRIVE/ALVERSON AND 41 ST ST/GRAND AVE <br />PEDESTRIAN IMPROVEMENTS <br />STATE FUND# HLP-PB15(032) <br />WO #3630 July 25, 2024 <br />33 <br />1 giving five business days notice to the Contractor to correct the breach, immediately <br />2 terminate the Contract or, at its discretion, procure or renew such insurance and pay any <br />3 and all premiums in connection therewith, with any sums so expended to be repaid to the <br />4 Contracting Agency on demand, or at the sole discretion of the Contracting Agency, offset <br />5 against funds due the Contractor from the Contracting Agency. <br />6 <br />7 H. All costs for insurance shall be incidental to and included in the unit or lump sum prices of <br />8 the Contract and no additional payment will be made. <br />9 <br />10 I. Under no circumstances shall a wrap up policy be obtained, for either initiating or <br />11 maintaining coverage, to satisfy insurance requirements for any policy required under this <br />12 Section. A wrap up policy is defined as an insurance agreement or arrangement under <br />13 which all the parties working on a specified or designated project are insured under one <br />14 policy for liability arising out of that specified or designated project. <br />15 <br />16 1-07.18(2) Additional Insured <br />17 All insurance policies, with the exception of Workers Compensation, and of Professional <br />18 Liability and Builders Risk (if required by this Contract) shall name the following listed entities <br />19 as additional insured(s) using the forms or endorsements required herein: <br />20 â–ªthe Contracting Agency and its officers, elected officials, employees, agents, and <br />21 volunteers <br />22 <br />23 The above-listed entities shall be additional insured(s) for the full available limits of liability <br />24 maintained by the Contractor, irrespective of whether such limits maintained by the <br />25 Contractor are greater than those required by this Contract, and irrespective of whether the <br />26 Certificate of Insurance provided by the Contractor pursuant to 1-07.18(4) describes limits <br />27 lower than those maintained by the Contractor. <br />28 <br />29 For Commercial General Liability insurance coverage, the required additional insured <br />30 endorsements shall be at least as broad as ISO forms CG 20 10 10 01 for ongoing operations <br />31 and CG 20 37 10 01 for completed operations. <br />32 <br />33 1-07.18(3) Subcontractors <br />34 The Contractor shall cause each subcontractor of every tier to provide insurance coverage that <br />35 complies with all applicable requirements of the Contractor-provided insurance as set forth <br />36 herein, except the Contractor shall have sole responsibility for determining the limits of <br />37 coverage required to be obtained by subcontractors. <br />38 <br />39 The Contractor shall ensure that all subcontractors of every tier add all entities listed in <br />40 1-07.18(2) as additional insureds, and provide proof of such on the policies as required by <br />41 that section as detailed in 1-07.18(2) using an endorsement as least as broad as ISO CG 20 <br />42 10 10 01 for ongoing operations and CG 20 37 10 01 for completed operations. <br />43 <br />44 Upon request by the Contracting Agency, the Contractor shall forward to the Contracting <br />45 Agency evidence of insurance and copies of the additional insured endorsements of each <br />46 subcontractor of every tier as required in 1-07.18(4) Verification of Coverage. <br />47 <br />48 1-07.18(4) Verification of Coverage <br />49 The Contractor shall deliver to the Contracting Agency a Certificate(s) of Insurance and <br />50 endorsements for each policy of insurance meeting the requirements set forth herein when <br />51 the Contractor delivers the signed Contract for the work.
