If the approved Progress Schedule indicates that the materials <br />4 procurement are critical activities, and if the Contractor has provided documentation that <br />5 purchase orders are placed for the critical materials within the prescribed 21 calendar <br />6 days, then contract time will be suspended upon physical completion of all critical work <br />7 except that work dependent upon the below listed critical materials: <br />8 <br />9 *** PPB POLES <br />10 PEDESTRIAN PUSHBUTTON <br />11 RECTANGULAR RAPID FLASHING BEACON SYSTEM <br />12 *** <br />13 <br />14 Charging of contract time will resume upon delivery of the critical materials to the <br />15 Contractor or *** 120 *** calendar days after execution by the Contracting Agency, <br />16 whichever occurs first. <br />17 <br />18 1-08.9.OptionB.RTF <br />19 1-08.9 Liquidated Damages <br />20 (March 3, 2021 APWA GSP, Option B) <br />21 <br />22 Revise the second and third paragraphs to read: <br />23 <br />24 Accordingly, the Contractor agrees: <br />25 <br />26 1. To pay (according to the following formula) liquidated damages for each <br />27 working day beyond the number of working days established for Physical <br />28 Completion, and <br />29 <br />30 2. To authorize the Engineer to deduct these liquidated damages from any <br />31 money due or coming due to the Contractor. <br />32 <br />33 Liquidated Damages Formula <br />34 <br />35 LD=0.15C/T <br />36 <br />37 Where: <br />38 <br />39 LD = liquidated damages per working day (rounded to the nearest dollar) <br />40 C = original Contract amount <br />41 T = original time for Physical Completion <br />42 <br />43 When the Contract Work has progressed to Substantial Completion as defined in the <br />44 Contract, the Engineer may determine the Contract Work is Substantially Complete. The <br />45 Engineer will notify the Contractor in writing of the Substantial Completion Date. For <br />46 overruns in Contract time occurring after the date so established, the formula for <br />47 liquidated damages shown above will not apply. For overruns in Contract time occurring <br />48 after the Substantial Completion Date, liquidated damages shall be assessed on the basis <br />49 of direct engineering and related costs assignable to the project until the actual Physical <br />50 Completion Date of all the Contract Work.
